SBCC Student Arrested for Causing Injury to a UCSB Police Officer
I don't mean to hijack this thread, but on 9/6, a friend of mine, a homeless women, took an old iphone from my home without my permission. I had allowed her to spend the night after she came to me crying actual tears about living in the Santa Ynez river bed. Unfortunately, 'you can take the girl out of the river bed, but you cannot take the river bed out of the girl', and at some point while I was asleep, Mariah made a beeline for the SYRB. When she showed up in front of my home a few days later, I made her understand that even though the phone was not all that valuable, it was a gift from my daughter that must be returned immediately if she ever intended to set foot in my home again. Space doesn't permit me to rehash the entire exchange, but the most important fact is that having a loud quarrel with another adult is NOT a crime. There were no threats, no violence - just loud accusations back & forth, and then she took her shopping carts and headed back to 'home sweet home(less)'. About 10 minutes later, 2 Lompoc police officers show up demanding that I let them enter my home, again, space doesn't permit me to recount the entire interaction, so the important points are that I have no obligation to voluntarily allow armed strangers to enter my home unless they have a search warrant signed by a judge, & listing specific items to be seized. Conversely, if the police really thought someone was being assaulted & I was preventing aide based on screams coming from inside my home, visible traces of blood, etc. they MIGHT have had a right to kick my security screen in and enter right there, too bad there was absolutely nothing but an anonymous 911 call. The catch with so-called "exigent circumstances" is that a 911 call is nothing but hearsay, and barring some actual evidence that a real emergency exists, then it's not "exigent". The inane excuse offered for detaining this UCSB student is just as laughable - every time some cop sees 2 or more "subjects" running in the same direction, he can jump them merely because he guesses an assault might just maybe possibly could occur, and if they "escape" him, then they are fair game for the entire department to physically assault? That may have been the plot for a cheesy Tom Cruse movie, but it's not law, and no "precog" ability is recognized as probable cause by any jurisdiction in this country. As for my situation, a former neighbor routinely sent the police over for no legitimate reason, and I've always been able to keep them in their place using common sense and my "hood" screen door, but this time they opened my large garage door & were headed for the smaller door that opened into my kitchen. For numerous reasons, I'm not going into details other than to point out that even though I had committed nothing that could be construed as a crime, I now had police officers attempting to enter my private home with at least one gun drawn & aimed squarely at me. I was able to keep at least 3 "officers" at bay after catching & forcing the door closed most of the way closed, but after just a few seconds one of them tried to Tase me twice through the 3 or 4 inch gap, fortunately for me, he was a lousy shot & missed me completely. A few seconds after that I lost the battle and cops forced their way into my home, only to "discover" exactly what I'd been telling them all along - Mariah was not in my home. At this point, any "peace" officer who wasn't COMPLETELY CLUELESS would've admitted the obvious, that there was no victim in my home apologized profusely while at the same time leaving the premises as rapidly as humanly possible. But the men who entered my home decided to arrest me and charge me with "felony" resisting/obstructing an "executive" officer - which can actually be anyone from a dog catcher to a judge, but includes cops. I spent 2 days in Lompoc jail before I appeared in court on Friday - on that day a man I assume was a public defender asked for a continuation of my arraignment, without even consulting me. I spent the weekend in the main jail in Santa Barbara expecting that I would be released on Monday, when for the second time the prosecution would fail to produce either a victim or even an accuser - but it was even more absurd than expected when the prosecutor tried to pretend that the transcript of the 911 call itself is some sort of privileged communication, that he alone has discretion to withhold or release - again this is preposterous, I'm 54 years old, and prior to this had never even been arrested, much less convicted of anything, but the act of repelling unlawful entry into my home by armed men makes me so incredibly dangerous, I'm not even allowed to know the general nature of the 911 accusation against me? Yeah, right. I'm not the least bit worried that this incident even came close to an "exigent circumstance", so spare me all the nonsense about Pelican Bay - there is no crime here, and there never was anything for the police to investigate...

Man Sentenced for Rape of Homeless Woman
He had priors convictions for robberies but was also charged with assualt under similar circumstances. Its is pretty hard to convict on the testimony of an intoxicated person. I can only presume the evidence was quite conclusive on the matter or there would have been at least one jury member to vote "not guilty" or that the case was not beyond a reasonable doubt. Happy it was resolved.
