Alleged DUI Driver Charged with Murder in Fatal Collision

Santa Barbara County District Attorney Joyce E. Dudley announced today that a felony complaint has been filed against Andrew Raymond Burgher, 31, of Santa Barbara. The charges stem from a collision on October 26, 2021, on Cathedral Oaks Road west of Camino Cascada in an unincorporated area of Santa Barbara County that resulted in the deaths of Gilberto Arteaga Gutierrez and Silvia Manzo Velasco.  Burgher was the driver and sole occupant of a 2016 Toyota 4-Runner that violently stuck a Ford Mustang driven by Gutierrez whose passenger was Manzo Velasco.  The force of the impact caused the Mustang to spin out of control and also collided with two parked vehicles along the south curb of Cathedral Oaks Road.

Mr. Burgher is charged with the following felony counts: two counts of murder in violation of Penal Code section 187(a) and one count of gross vehicular manslaughter while intoxicated in violation of Vehicle Code section 191.5(a) alleging that Mr. Burgher previously suffered a prior conviction within the meaning of Penal Code section 191.5(d).  The complaint also alleges that Mr. Burgher suffered two prior misdemeanor DUI convictions.   

Additionally, it is further alleged that Mr. Burgher personally inflicted great bodily injury within the meaning of Penal Code section 12022.7(a) and proximately caused death or bodily injury to one than one victim within the meaning of Vehicle Code section 23558.

Penal Code section 191.5(d) is also known as “Courtney’s Law”, which was enacted to stiffen penalties for repeat DUI offenders, if and when a future DUI results in the tragic loss of life.

On October 28, 2021, Mr. Burgher appeared in Department 8. The case is next set for further arraignment in Santa Barbara Superior Court at 8:30 a.m. on November 3, 2021.  Bail has been set at $2,050,000.
