Take a look at the books and software at Nolo Press, http://nolo.com. They are reputable publishers of legal self help information. If your situation is complicated, a lot of assets, and, especially, if you have a family for whom you want to provide or, conversely, don’t want to provide, then it would be wise to have the result looked over by an attorney, any of these mentioned or others who specialize in Wills/Trusts.
Recently my neighbor had gone through this procedure and he had hired an attorney from http://www.tarabay-gemayel.com/ and had a good experience with it. I know someone who has money, but no will, trust or health care directive. Also no family. That someone has been sucked up by the system and can't get out of it. The determination of mental incompetence is unwarranted, IMO.
I am a retired attorney and agree that the need for a will is questionable in most cases. Generally it seems related to attempts to 'get even' with or otherwise manipulate heirs and others. I don't have a will and am happy to let my estate transfer in the manner provided by the laws of the state of California. In any event I will not be around to complain and cavil about how it happens.
PLease, Please Please don't try to draft a will yourself. I am a retired estate and trust attorney and I can tell you many sad stories about people who have done this with devastating and expensive consequences. It's definitely worth the cost to hire a trained professional to handle this important matter, especially in California where the estate and trust laws are byzantine.
Stefanie Herrington did our very detailed trust. she does a great job. Also, she is wonderful for getting military veterans taken care of, the only lawyer in SB, as far as I know, who does that. She took care of a 97 year old friend and got him amazing benefits, including $1,800 a month due to anyone serving in a declared war (they don't need to have been in the fight). She got rid of a woman trying to scam him.
