Russell Maxwell Phay, the 42-year-old military veteran from Nevada accused of violently assaulting a woman at Beanie Babies mogul Ty Warner’s Montecito mansion, has been deemed competent to stand trial. This decision was made in a recent Santa Barbara courtroom appearance before Judge Steven Foley, where both Phay’s defense attorney and the District Attorney’s representative agreed on his mental capacity to proceed.
Phay, described by his family as a violent schizophrenic in court documents, faces serious charges of attempted murder and kidnapping following an intrusion on Warner’s property on May 21. The incident, involving the brutal assault of Linda Malek-Aslanian— Warner’s investment advisor—left her in a prolonged coma after court documents state Phay “kicked, stomped, and dragged” her across the estate’s front lawn. The current condition of Malek-Aslanian remains unreleased to the public.
At the time of the attack, Warner was at his sprawling oceanfront property, though there is no information indicating any direct confrontation between him and Phay.
Law enforcement, initially perceiving a hostage crisis, responded with helicopters, a BearCat armored vehicle, and police dogs. After a standoff, Phay was apprehended when he attempted to escape from an upstairs bathroom window.
No discernible motive has been presented linking Phay to a specific grievance with Warner, known for his reclusive nature and ownership of prominent local properties such as the Four Seasons Biltmore and San Ysidro Ranch.

Additionally, new charges were added linking Phay to another violent episode earlier on the same day. Court documents now indicate an assault on a resident of Arroyo Quemada Lane in Goleta, where Phay allegedly attacked “Victim #2” while she confronted him for using her water hose, causing her serious injury.
Phay’s previous criminal history includes a 2018 arrest in Siskiyou County on assault and battery charges. He was also named in a 2024 complain for allegedly making threats of the phone to a family in Arroyo Grande, the San Luis Obispo County Sheriff’s Office stated.
Phay’s trial, expected to commence in September, is proceeding following Judge Foley’s decision to formalize the trial schedule on August 25.

I had a violent schizophrenic half sister who is now deceased. I beg our government to reopen mental institutions! My sister wandered around for years until she stabbed 2 people and was institutionalized at a psychiatric facility. It was the best thing that could have happened for her! Thank God the victims did not die but definitely could have. The families of violent schizophrenics do not always the means to know where the relative is let alone help them.
How can our society let these people roam about….? I blame the ACLU who instigated the closing of the mental hospitals like Camarillo.
