Third-Time DUI Suspect Critically Injures 91-Year-Old Man in Crosswalk

On Tuesday evening, January 23rd, 2018 at 7:34 P.M., Nicholas B. Hart, a 26-year-old Goleta resident, was traveling southbound on State Street at a high rate of speed when his vehicle struck and severely injured a male pedestrian. 

The 91-year-old elderly victim was attempting to cross the street in a marked crosswalk at the intersection of State Street and Micheltorena Street. 

Hart, driving a 2003 Honda Civic with a suspended license, was found to be driving under the influence of alcohol and also believed to be influenced by prescription drugs. His blood alcohol content was approximately three times above the legal limit. Hart also had in his possession an open bottle of alcohol and marijuana.

Hart’s license had been suspended because of two prior DUI convictions. This is his third DUI arrest in just under 3 years.

The elderly victim is a Casa Dorinda resident that was displaced during the mudslides.  He was transported to Cottage Hospital for treatment. The 91-year-old is listed in “critical condition” with life-threatening injuries.

Because of the seriousness of his crime, Nicholas Hart is being held on $1M bail at the Santa Barbara County Jail.  The charges include felony DUI drugs with injury (23153(g)CVC), felony DUI alcohol with injury (23153(b)CVC) and driving on a suspended license for prior DUI’s (14601.2CVC).

Additional charges may be applied. The investigation remains on-going.

  1. Oh! the walls for when you drink and drive… you go to jail and by the third time you don’t learn your lesson we don’t have to deal with you for the rest of your life wall? I think we have a few sets of walls like they call state prison. No need to build a wall for this right now unless you mean pedestrian walkways. Very sad that you would bring national politics in this. How about the issue of drinking and driving? seems more pertinent.

  2. He was Illegal. He was drinking and killed someone while speeding. He is going to jail for life and if you want to apply the death penalty then you will need to work with the courts. I am not sure I am with you on the death penalty.

  3. I have no idea? It happened in SF but it was 5x felon that was not here legally and he shot a young lady walking her old guy dad. The guy with the wrapped gun is working on deportation proceedings because he is not from here. The guy with a drinking problem that just ran over an innocent old man is in jail on 1m dollars bail and I think he should rot just like I think the guy on his way back to Mexico should. Thats not racist thats standing up for what is right IMHO. National politics has nothing to do with this is exactly what I am saying. But if someone wants to start comparing that is what I have so far.
