Paddle Boarder Charged with Assault in Morro Bay Surf Dispute

A paddle boarder was charged with felony assault stemming from a surfing altercation in the waters off Morro Bay last month.

Andrew Eric Gustafson, 59, is charged with two felonies, assault with a deadly weapon and assault by means likely to produce great bodily injury. 

The San Luis Obispo County District Attorney’s Office filed a criminal complaint on August 26 claiming that Gustafson used a paddle board paddle to assault a victim named “H.R.”

On August 23, California State Park Rangers received a 911 call around 10:45 a.m. regarding a physical altercation in the water off Morro Strand State Beach.

State Parks confirmed a suspect was arrested for felony attempted murder, assault with a deadly weapon, and battery, reports the San Luis Obispo Tribune.

The District Attorney’s Office later dropped the attempted murder charge.

Gustafson entered a plea of not guilty to both felony charges during his arraignment Wednesday, August 27. 

His preliminary hearing has been scheduled for Monday, September 8 in the San Luis Obispo County Superior Court.

San Luis Obispo County jail logs show that Gustafson was booked on felony assault charges on August 23, but was not listed in the logs the following day.
