    • SACJON, in most states it is a crime to damage a person’s vehicle like this. Here, if the damage is $400 or under it’s a misdemeanor and if over $400, can be charged as a felony. Both carry jail time, up to a year plus fines. In addition, it can be assault depending on the circumstances. If the person kicks or damages your car and runs then it may be just criminal mischief but if they circle like this, and it’s intended or does threaten, then it can be charged as assault.

    • lol 4 people disagree with this being vandalism? What on earth else would it be? MAYBE assault, as sometimes hitting a car can be viewed as assault, but honestly…. what do you all really think this is? It’s not “hit and run” because it wasn’t a collision. Folks, this sucks, but you can’t go charging people with felonies because they kicked your car.

    • RHS – vandalism is a CRIME as well. Under CA Vehicle Code S. 2002, a hit and run is deemed when “The driver of any vehicle involved in an accident[.]” This wasn’t a traffic accident. This was an intentional destruction of property, ie, vandalism. Could also be prosecuted as an assault, depending on the circumstances. I just don’t understand all the blow back I’m getting for pointing out vandalism being the most likely criminal action the OP has available.

  1. Sorry you had to experience this. There are a lot of crazies out there and interacting with them is not recommended. Honking your car horn and then calling out to say you’re involving the police is not a safe thing to do. You don’t know who is packing a gun or knife or machete nowadays. Hopefully police will take this seriously.///////// It’s good that you posted about this guy and made others aware, but next time please think of your own safety. Before others state it, I will say that it is pretty much guaranteed that if this dude is arrested, he will be back on the streets in no time, acting out and quite possibly creating more harm than denting someone’s vehicle.

  2. Straight kook – riding around while wearing a mask? Yeah, in the future I wouldn’t recommend the honk either. I know what you were thinking, hey I feel the same way – “wake up you clown I’m trying to drive here and you’re fooling around on the road” – but like others have said, these days in SB (and certainly elsewhere) you never know what kind of criminal you might be dealing with.

  3. I called the police on this person doing the same thing a few weeks back. Was intentionally trying to create chaos on the road driving in his jolly circles. I’m not sure if they dispatched anyone, but I certainly didn’t feel any urgency from the 911 operator. [Probably get 20 calls a day that sound the same.] Either the police don’t care, or more likely they care but know that their efforts won’t matter as no one is allowed to be punished for anything these days…

  4. Looks like another crazy or angry or both vagrant. You can’t get blood out of a turnip so no fine will be paid. A week of free room and board at the local hoosegow and an 8-hour work detail might slow this type down and there’s always lots of litter to be picked up along roads and streets and business entrances to be washed free of urine. With no deterent, there’s not reason not to act out.
