Assault on Carrillo

I was driving to work this morning on Carrillo at the Garden Street intersection and this guy was riding his bike in circles very erratically and almost hit my car. I briefly honked to let him know I was there and he circled around and kicked the side of my car so hard it left a dent. I am a female driving alone so I was very shaken up as I never had anyone do something like that before.
Luckily there was a witness who took this photo and a video which is too large to upload here. I rolled down my window to tell him I would be calling the police and he just glared at me and shrugged like "go ahead". He continued to circle around the intersection in a menacing manner. He was riding very slowly and eventually rode away but very slowly, down Santa Barbara street. The witness pulled over and gave me their name, this person also felt threatened.
I will be filing a police report once the station opens at 1 p.m. and plan to press charges if they can find him. Does anyone know this person? I also have video as I mentioned and can send that to you through edhat as well. Thanks in advance to our community members, this person needs to be off the street before he harasses or bullies anyone else as he is very menacing.

Jan 31, 2023 03:46 PMthe guy is a total dikwad. he pulled that stunt in front of my daughter and i when we were downtown last weekend. i've seen him around and know he's a loon. just move past him. also, tha cops aren't really interested in this. they do have much bigger things going on than another loon riding around. i punched someone's car just last week. they scooted through a red light so they could get in line at the next red light, blocked the bike path and forced me out into the car lanes so i nailed their trunk as hard as i could with my fist. i'll happily do that again if anyone wants to jeopardize my safety and others around me. running a red light to get in line at the next red light when the traffic is already backedup into the intersection....genius move.

Jan 31, 2023 08:47 AMMany cyclists here in SB have that road warrior mentality. But an auto is much bigger and can to damage to them for being erratic on their bikes and sometimes they pay the price for that kind of behavior. Not all cyclists are like that just to very clear.

Jan 31, 2023 08:40 AMYup, had the experience of meeting this guy when he blocked a WALKING path at Paseo Nuevo with his bike. Narrow walkway next to where Rite Aide was and he was riding in the opposite direction. As we were about to pass each other, he abruptly stopped and turned his bike sideways so I couldn't pass him. I stopped and just stared at him waiting for him to move his bike and he smuggle asked me if I was scared. I said NO! With that he moved his bike and road away. Personally that really disturbed me and I was stupid enough to be more pissed than afraid.

Jan 31, 2023 08:30 AMLooks like another crazy or angry or both vagrant. You can't get blood out of a turnip so no fine will be paid. A week of free room and board at the local hoosegow and an 8-hour work detail might slow this type down and there's always lots of litter to be picked up along roads and streets and business entrances to be washed free of urine. With no deterent, there's not reason not to act out.

Jan 30, 2023 08:31 PMI called the police on this person doing the same thing a few weeks back. Was intentionally trying to create chaos on the road driving in his jolly circles. I'm not sure if they dispatched anyone, but I certainly didn't feel any urgency from the 911 operator. [Probably get 20 calls a day that sound the same.] Either the police don't care, or more likely they care but know that their efforts won't matter as no one is allowed to be punished for anything these days...

I know what you were thinking, hey I feel the same way - “wake up you clown I’m trying to drive here and you’re fooling around on the road” - but like others have said, these days in SB (and certainly elsewhere) you never know what kind of criminal you might be dealing with.

I'm confident Chief Gordon and likely one of her staff read local news publications, i.e. Edhat. A little "intelligence gathering" to learn what people in the community are doing/saying. Chief, it would be nice to learn why PD lobby hours remain restricted.

Jan 30, 2023 04:59 PMSAND - Looking further into an old (undated) PD online posting, the PD reported the in-person lobby service (mixed short hours) began on 11-28-22 to follow County Public Health Department guidelines. COVID was not mentioned specifically as the reason. I can only imagine how long one will wait for a telephone call response. What did I miss that permits the PD to continue their (short) lobby hours policy? I can understand a shortage of personnel if cops worked the lobby, but I believe support personnel work in lobby positions. Does the PD also have a shortage of civilian personnel?

Honking your car horn and then calling out to say you're involving the police is not a safe thing to do. You don't know who is packing a gun or knife or machete nowadays. Hopefully police will take this seriously.///////// It's good that you posted about this guy and made others aware, but next time please think of your own safety. Before others state it, I will say that it is pretty much guaranteed that if this dude is arrested, he will be back on the streets in no time, acting out and quite possibly creating more harm than denting someone's vehicle.

Under CA Vehicle Code S. 2002, a hit and run is deemed when "The driver of any vehicle involved in an accident[.]" This wasn't a traffic accident. This was an intentional destruction of property, ie, vandalism. Could also be prosecuted as an assault, depending on the circumstances. I just don't understand all the blow back I'm getting for pointing out vandalism being the most likely criminal action the OP has available.

MAYBE assault, as sometimes hitting a car can be viewed as assault, but honestly.... what do you all really think this is? It's not "hit and run" because it wasn't a collision. Folks, this sucks, but you can't go charging people with felonies because they kicked your car.

Jan 30, 2023 06:51 PMThis is a hit and run CRIME. Police should be interested. Bicycles are vehicles and if involved in an incident they need to stop and identify and provide information to allow subsequent resolution of the problem in a fair way.

Jan 30, 2023 01:55 PMSACJON, in most states it is a crime to damage a person's vehicle like this. Here, if the damage is $400 or under it's a misdemeanor and if over $400, can be charged as a felony. Both carry jail time, up to a year plus fines. In addition, it can be assault depending on the circumstances. If the person kicks or damages your car and runs then it may be just criminal mischief but if they circle like this, and it's intended or does threaten, then it can be charged as assault.
