Real Estate Lawyer
updated: Mar 29, 2011, 3:37 PM
I recently inherited a small apartment complex in Santa Barbara with my siblings.
I'm in need of an attorney to help us create an LLC. I'm assuming I need one that
deals with real estate and/or rental properties. Any recommendations?

I work for one -- I think he's the best in town. Chris Jones, chris@eatonjones.com; www.eatonjones.com; 963-2014. Used to head the county bar probate section. Very knowledgeable and personable. Has a great paralegal, too :)

Don't rush into forming an LLC merely because you think that is what you need. There are many other methods of holding title that may work as well or better to meet your needs. If protection from liability is your primary concern, remember that adequate insurance will cover costs of defense as well as nearly all liabilities. Interview an attorney before committing to one, just to make certain that he or she communicates in a style that works for you and/or your siblings. Like with any other professional, what works for one person may well not work for another person Don't be reluctant to change if the attorney you first select is not working for you. BTW my law firm does this sort of work as well

Our family has interviewed and or worked with several in town including the above and I would say Chris Jones is the best by far. We have owned real estate in SB for many generations.

Agree 100% with Rob Egonolf adding that the EXIT strategy from an LLC is extremely important. Tax law related to partnerships is very important.

If you're looking for an attorney, I can attest to a number of them mentioned here. Dana Longo and Greg Merrill are both excellent. They operate small practices, and so their fees may be a bit lower than with larger firms with more overhead. We have referred our clients to both these attorneys and will continue to. Joe Howell and Kim McDaniel are at Howell Moore & Gough LLP and are also excellent attorneys. We've referred business to them as well and we've received nothing but stellar comments about them. If you have spoken with an attorney and know what type of entity is right for you, our company, Formation Solutions, can help do the filings and paperwork at a very reasonable cost. All of the above attorneys have referred clients to us to help their clients with this work. Please feel free to contact me at www-dot-formationsolutions-dot-com. I'm happy to chat about your project. Matthew Burgess, CEO Formation Solutions, Inc.
