Anti-Solicitation

I was out at Goleta Pier this morning for the first time in awhile. Walking through the patio area at the foot of the pier I was approached by two Jehovah Witnesses who had set up a literature stand at one of the tables. Doesn't the County have an anti-solicitation ordinance?

Were they asking for anything? Or just offering pamphlets?

Solicitation, from the defenition i just looked up is to "ask for, or try to obtain ( something ) from someone "

Last time i interacted with jahovas witness's they didnt ask me for anything, but wanted to give me things ( pamphlets )

All you had to say was, "No thank you!" or something similar. As for an ordinance, it would depend on how it was phrased; people have a right to offer reading material, if that's what they were doing - and if the County were to attempt to ban it, there would be a constitutional challenge.

I'd think there'd be more of an uproar over the people that leave business flyers/cards on car windows. Both annoying and littering (and trespassing?), and it seems the businesses would be easy to find (fine).

Solicitation is asking for money or offering services for money. Did they ask you for money? If not they are protected by the First Amendment.

Annoying as it is to be proselytized every which way till Sunday freedom of religion and free speech protects their right to converse with you and you have the right to decline doing so. Easy peasy.

And businesses leave flyers, advertisements at my front door. If I'm gone it attracts attention. Wish they wouldn't do this. Sometimes I contact them, but then another will do it.

The same (and even more so) goes for whoever leaves those worthless phone books in my driveway - you know the ones that don't even have any local business numbers, they're all in Thousand Oaks or SLO?

How can dumping unasked for phonebooks in my driveway not be considered littering?

I remember the good old days when people had a work ethic. The JWs used to go door to door, up hills and climbed the stairs. Setting up a table is just plain lazy

Rather than speculate just look it up:

Sec. 26-16. Soliciting prohibited

No person shall solicit, sell, hawk, offer or provide in a commercial context, any goods, wares, services, merchandise, liquids or food; or advertise or distribute any written or printed material within any county recreation area except by concession agreement or upon the specific authorization of the county director of community services or deputy. No person shall offer, conduct or deliver lessons, services or amusements within any recreation area except by concession agreement or authorization of the county director of parks or deputy.

Businesses also need to be more vigilant I don't want to be approached as I leave the grocery store. Trader Joe's on DLV is especially bad. So I stay away from stores that allow this outside their doors.

With referance to 500P's posting of the ordinances it looks like the operative words are " in a commercial context." Would a phamplet explaining a particular religion be considered a commercial venture? It would seem that they know the law as they never ask for money. Although it seems to be implied as they would like you to pay a small sum for the booklet.

Mesarat: I'm not a JH fan or even religious, but I don't think setting up a table and handing out flyers is necessarily "lazy." Judge that ye be not judged and all that......

Some posters here are wrong about "missing" work ethic like "the good old days." For the record: I live near downtown SB. I have had both Jehovah's Witnesses and Girl Scouts selling cookies come to my door recently. And they had to climb up stairs to do so.

We've told them to take our house off their list because they give us a phamplet, ask for money and take up our time, we already have so many religious groups trying to spread the "word" so tired of being bothered, especially on Sunday. Dad always said his sign "we shoot every third jehova's witness and the second one just left!" always worked.

They are tenacious. I've had the same one come back numerous times to my door even though I've said I'm a Buddhist and think they are a harmful cult since they shun people/family members that leave the church (just like Scientologists). How 'Christian' is that.

Within SB city limits, you are supposed to have a permit to solicit door to door, which is very different from solicitation in county parks. The permits are pretty cheap, but can take months to get, and they probably can't require them for people expressing their free-speech views (as opposed to taking money as contributions or as payment for stuff being sold). SB county also requires permits for solicitation. As far I've ever been able to tell can tell, Goleta and Carp are content to just rely on the county permits.

If there are any "do not call" lists for physical addresses, I have yet to discover them. Hopefully, people will be respectful of "no soliciting" signs. When they are not, try to be polite and if the solicitor does not take the hint, then closing the door will usually provide much faster and more effective relief than calling the cops or calling for yet another ridiculous and unenforceable city ordinance.

All you have to do is just say no and keep on walking - I've never felt the need to be rude to them. They have their thing - I have mine. The twain won't be meeting any time soon. You have to put a lot of stuff on ignore status in the world and just focus on what you need to do - it works.

It's really not that hard to get rid of them. But I'm one of those people that doesn't answer his phone or his door unless I recognize the voice or know the people.

If I want to talk to strangers I go to lower State Street.
