Woman Receives Probation After DUI Crash

The Independent is reporting that a local woman has been sentenced to probation after a May 2013 DUI crash left her 3-year-old son with a broken neck.

According to The Independent Judge Clifford Anderson sentenced 25-year-old Kate Hatrey Walters on Monday to four years of probation. "Walters, who was also ordered to a residential treatment facility, faced a maximum sentence of 10 years and 8 months in prison. Prosecutors had declined to offer Walters any kind of plea deal and argued against probation. According to Senior Deputy District Attorney Arnis Tolks, Walters pleaded guilty to DUI and child-abuse charges, along with a number of enhancements. If Walters violates her probation, Tolks went on, she'll be sentenced to prison."

On May 20, 2013, the Santa Barbara Police Department received reports of disturbance in progress involving intoxicated subjects in front of Harry's Plaza Café. Upon arrival, SBPD encountered Walters, heavily intoxicated and distraught with her 3- year-old son bleeding from abrasions to his neck. Investigations determined that Walters and a friend were drinking heavily during the day and were subsequently asked to leave Harry's after being unruly and argumentative.

Walters, her son, and her friend left the Loreto Plaza parking lot nearly missing several parked cars. She continued to drive two blocks westbound on State Street until she reached the intersection with Toyon Drive. She struck the curb and drove up onto the sidewalk, striking the State Street / Toyon Drive street sign there and then collided with the lamppost of a city street light. The force of the collision caused the vehicle airbags to deploy. Walters's 3-year old son sustained multiple injuries from the collision including a broken neck.
