Loaded Firearm Arrest

Phillip Edmond Cummings, age 41, of Santa Barbara, was arrested for possession of a loaded firearm in public.
On February 18, 2014 at 11:49 a.m., officers from the Santa Barbara Police Department responded to a call of a man brandishing a
handgun on the 1100 block of De La Vina Street. The suspect, Cummings, was contacted at his apartment at that location and taken into custody. Cummings
had a loaded 9mm handgun tucked into the rear of his waistband.
Investigation indicates the following. Just prior to the call Cummings was walking his dog when he observed a neighbor's dog
unsecured in a shared driveway adjacent to their apartments. Cummings has the perception that his neighbor's dog is a dangerous animal. Cummings quickly
took his dog home and retrieved a loaded 9mm semiautomatic pistol from his residence. He returned outside and confronted his neighbor's dog, yelling at it
to "get back" and to "get behind the fence" while pointing his gun at it. Cummings then returned to his home. Witnesses saw and heard the commotion and
called the police, directing the officers to Cummings's residence. Cummings was taken into custody without incident when he came to his door.
Cummings was booked into Santa Barbara County Jail for possession of a loaded firearm in public with a bail amount of
