Brandishing a Replica Firearm Arrest

Aaron Matthew Perez, age 25, of Santa Barbara, was arrested for brandishing a replica firearm in a rude or threatening manner, a
misdemeanor. Perez was found to be in possession of two BB guns that are replicas of the Heckler & Koch MP5 submachine gun.
On September 5, 2013 at 7:50 a.m., officers from the Santa Barbara Police Department responded to a call of a subject with a
gun at the intersection of Garden Street and Micheltorena Street. The first responding officer was on-scene in less than 90 seconds and detained the
suspect, Perez, at gunpoint.
Investigation revealed the following. The victim in this incident is a 36-year old male Santa Barbara resident that was riding his
bicycle eastbound on Micheltorena Street, approaching the intersection with Garden Street. Perez was standing beside his car which was parked near the
intersection. As the victim rode past, Perez withdrew one of his BB guns from his car and with a smirk on his face pointed it at the victim. After the victim
rode away Perez put the BB gun back into his car. Once a safe distance away the victim called the police.
The victim conducted a citizen's arrest of Perez for the crime of brandishing, necessary because the offense is a misdemeanor
that was not committed in the officers' presence. Perez is currently in custody at the Santa Barbara Police Department and will be booked into Santa Barbara
County Jail on the aforementioned charge with a bail amount of $2,500.00.
In the photograph of the guns, the weapons in the top and center positions are the BB guns that belong to Perez, with the gun in
the center being the one that was used in this incident. For comparison, the weapon in the bottom position is a real H&K MP5 submachine gun, property of
the Santa Barbara Police Department.
