Gang Related Attempted Murder & Hate Crime Arrest

A seven-week investigation by detectives from the Santa Barbara Police Department's Youth Services
Section culminated with the arrest of David Roberto Ybarra, age 19, and a male juvenile, age 17, both of
Santa Barbara, for the crimes of attempted murder, attempted robbery, participation in a criminal street
gang, and commission of a hate crime. Both suspects are members of a Santa Barbara area gang. The
victim, a 40-year old male Santa Barbara resident with no gang affiliation, was attacked with a hammer.
On June 22, 2013 at 10:08 p.m., SBPD officers responded to a 9-1-1 call of an assault with a deadly
weapon that had just occurred in Ortega Park involving a subject that had been hit on the head with a
hammer. Upon arrival the officers located witnesses and the crime scene, however the victim had
already left the area with a friend. Shortly thereafter the victim was located at his residence suffering
from a serious head injury. He was transported by paramedics to Santa Barbara Cottage Hospital
Emergency Room and underwent treatment at the hospital for approximately one week.
Investigation indicates the following. At the time of the incident the victim was playing cards with
companions in Ortega Park. Ybarra, the juvenile suspect, and an associate approached the group,
identified themselves as gang members and told the victim and his companions that they were not
welcome in the park because of their Mexican nationality. The suspects then demanded money. After
hearing someone in the group whistle, which was perceived by the suspects as an insult or challenge,
the suspects singled out the victim and approached him. Ybarra produced a hammer from his clothing
and struck the victim on his head in the area of his left temple. The two suspects and their companion
then fled the scene. Investigation established that the crime was done in furtherance of the objectives
of a criminal street gang and that the victim was targeted because of his nationality.
Ybarra was arrested on August 9, 2013 following his release on bail from Santa Barbara County Jail for a
different offense. He was booked back into County Jail on the aforementioned charges with a bail
amount of $780,000.00. The juvenile suspect was placed in custody on these charges on August 11,
2013. At the time he was already in custody for an unrelated offense. The Santa Barbara County
District Attorney's Office has indicated their intention to prosecute the juvenile suspect as an adult.
