Sergio Ivan Soto Arrested

Sergio Ivan Soto, age 30, of Santa Barbara, was arrested for numerous felonies including possession of an AK-47 assault rifle. Soto is a felon whose criminal history includes a conviction for being an associate of an Oxnard area criminal street gang.

On May 2, 2013 at 5:40 p.m., an officer from the Santa Barbara Police Department's Criminal Impact Team was standing on 300 W. Pueblo Street when he saw Soto drive by in a silver Nissan Altima. The officer recognized Soto as someone whom SBPD detectives had just obtained a felony arrest warrant for forgery. The officer went to his car and followed Soto's vehicle, in the process noticing that it was displaying fraudulent registration tabs. The officer initiated a traffic stop on 2400 Fletcher Avenue and contacted Soto, who initially gave a false name. Soto was arrested for his warrant, for providing false information to a peace officer, and for displaying fraudulent registration tabs.

Soto's vehicle was searched incident to his arrest. A small quantity of methamphetamine, a meth pipe, and other drug paraphernalia were found inside the passenger compartment. Also found there were nine personal and business checks belonging to different people and sensitive items of mail consisting of social security paperwork, bills, bank statements, and tax returns belonging to four others. Several of the owners were later contacted and all advised that Soto did not have permission to be in possession of their checks or mail.

The trunk of Soto's vehicle was found to contain a semi-automatic AK-47 rifle with a collapsible stock, fourteen-inch barrel, and detachable thirty-round magazine. The magazine was loaded with twenty-two rounds of 7.62x39 mm ammunition. The weapon is not registered.

Soto was booked into Santa Barbara County Jail for his warrant and on the following charges with a bail amount of $250,000.00:

· Possession of an assault rifle, felony

· Transportation of an assault rifle, felony

· Convicted gang member / violent felon in possession of a firearm, felony

· Felon in possession of a firearm, felony

· Felon in possession of ammunition, felony

· Possession of stolen property (3 counts), felony

· Possession of methamphetamine, felony

· Possession of drug paraphernalia, misdemeanor

· False information to a peace officer, misdemeanor

· Fraudulent registration tabs, misdemeanor

Wait....I thought the assault weapon ban was supposed to keep them out of the hands of the bad guys!? It looks like the only to have one is a violent criminal, leaving the rest of us outgunned and much less able to defend ourselves if he decided to turn it on us. The assault weapon ban is another stupid idea of the extremist left and, like most of their stupid ideas, has utterly failed.

Lemme get this straight.... because his AK has a 'collapsible stock' it is considered an assault weapon? Last I checked 'Assault Rifles' are FULLY-automatic rifles not SEMI-auto as stated in the report....Although I believe a felon to be in possession of a firearm as well as high capacity magazines to be very bad, I also consider the media's all out distortion of what 'Assault Rifles' actually are since this whole Sandy Hook mess is even more dangerous...

Well said last two posters. Just another example that gun laws will do nothing to keep weapons out of the hands of criminals. The media is using the words Assault Rifle to scare people who know nothing about guns. Quick reality check every weapon is an assault weapon including a knife or whatever.

The second amendment is for the people to have the same weapons as the Gov't to keep them in check.

I agree with 033, the Second Amendment is to ensure we are on equal footing with the government to protect us against undue tyranny.

With that in mind, I believe that entitles me to an M1A1 Abrams tank. A gun simply won't do against a heavily armed, technologically advanced military.

To all those making comments about the assault rifle ban - The ban on assault rifles expired in 2004 and although there have been multiple attempts to renew the ban, no bill has reached the House floor for a vote.

Just to make sure you are fully informed. Assault rifles can be semi automatic or fully automatic.

033 - Nowhere in the (very brief and quivocal) 2nd Amendment does it say the people are entitled to own the same weapons as the government (US military included).

If that were the case, then citizens would be able to purchase fully automatic weapons, grenade launchers, laser guided missiles, nuclear weapons, etc.....

I agree with the 2nd amendment-that a well regulated militia shall have their guns (back in the day, that was usually one rifle each). BUT did you know that 2/3 of gun related deaths in the U S, according to the CDC, every year, are suicides? I don't think that's what our founding fathers had in mind. This is about gun manufacturers making MONEY.....and not caring that your loved ones have access to guns.

Okay 407100 explain to me exactly what you classify as an 'Assault Rifle' because the UN definition is any FULLY-automatic LONG rifle. You do realize an AR-15 (Armanian Rifle-15 not Assualt Rifle-15) is the semi-automatic version of the military's fully-automatic M4A1 long rifle..... And in many states it is legal to own, purchase and shoot fully automatic rifles, handguns even shotguns. You should touch up on your gun knowledge.

SACJON - Nor was it necessay for the 2nd Amendment to differentiate between military and civilian weapons at the time. When the 2nd Amendment passed in 1791 the most technologically advanced guns (used by both the military and civilians) were single shot musket rifles. The most destructive weapons of that era were cannons and it was legal for civilians to own them. In fact most small bore muzzle loading cannons are still legal to own today. Even flamethrowers are legal in 40 states.

144 - An assault rifle is a selective fire (selective between automatic, semi-automatic, and burst fire) rifle that uses and intermediate cartridge and a detachable magazine.

163 - so, are you saying we should be able to own the same type of weapons as our military? I should be able to build an ICBM launcher in my back yard?

I really doubt this is what our forefathers intended when drafting this Amendment.

SACJON - I think you have misinterpreted my comment on the 2nd Amendment. I was pointing out how times have changed since 1791 regarding the destructiveness of weaponry and I completely agree with you that military style weapons should not be in the hands of civilians.

The forefathers could not have imagined weapons such as ballistic missiles and their intentions when drafting the 2nd Amendment were to allow civilians to defend themselves.

His weapons are banned in California due to our superior gun laws. This means law enforcement can take his illegal weapons and ammo away permanently, and file additional weapons charges against this guy.

That's how laws work -- they don't stop people from doing illegal things -- it just gives us the ability to arrest them for it when they do.

I suppose all of you claiming that our gun laws don't work would prefer he be able to keep his weapons and oversize clips so he can use them in the future or give them to one of his fellow gang members?

clearly those whining about about assault weapon bans have never been in a live fire fight with one. you really think it would make a difference if you were an assault rifle owner when someone opens fire on you? join the marines and get some first hand experience you kooks.
