Court of Appeal in Sacramento Denies District Attorney's Petition
to Prevent the Release of Tibor Karsai into Santa Barbara County
District Attorney Joyce E. Dudley announced today that on Thursday afternoon, February 7, 2013, the
Court of Appeal for the Third District denied the Writ of Mandate tiled by Santa Barbara County District
Attorney Joyce E. Dudley.
In so doing the Court of Appeal concluded that an individual deemed to be a "sexually violent predator"
(SVP) can be released as a transient in Santa Barbara County. In their 21-page opinion the Court of
Appeal ruled, "There is nothing in the SVPA that precludes a court from ordering the conditional release
of a person committed as an SVP even though no fixed residence has been located for the person before
his release." The Santa Barbara County District Attorney's Office will now file a second Petition for
Review to the California Supreme Court in a final attempt to prevent Tibor Karsai from being released as
a transient into Santa Barbara County. In addition, the Santa Barbara County District Attorney Will once
again be filing a stay to stop Mr. Karsai's release while the matter is pending before the Supreme Court.
