I have had a horrible experience with evicting a tenant in the past. The best advice I can give you is to go to the Sheriff's Civil Bureau at the courthouse. When someone is evicted and there are any problems with the eviction, the courts ONLY recognize eviction notices served by the Sheriff

As a landlord, the best advice I can give you is to hire an attorney to take care of the entire process. It's not that expensive and it's worth the investment.

Really? Just because someone is a Landlord, they must know the devil?

It's a tough economy, people who never thought they would have to rent out their property are now in that situation. Some have to rent rooms inside their own homes and share with the renters, some of whom get a pretty nice deal in a good home.

And those who rent have a contract to fulfill. Sometimes stuff happens and someone has to be asked to leave... if it can't be done willingly, one has to evict.

Being asked to go does not presume there will not be enough time for the renter to find other accommodations.

Common sense.

I just read about a landlord in South Chicago that shot his tenent mulitaple times..Killing him witnesses said it looked like something out of a movie.

I second talking to the Sheriff's Civil Bureau. Evictions can be a very drawn out and complicated process. I know from experience years ago as a tenant watching the whole process take weeks to evict a bunch of meth addicts and dealers from the upstairs unit of the duplex my (then pregnant) wife and I had just rented.

They were supposed to be out before we moved in but it took a couple weeks to finally have the Sheriffs physically remove them. Not fun.

SB Property Owners Association has every rental-related form you need - for members. I've used theirs and the ones in Nolo Press Landlord's Law Book. Nolo also has an eviction book that I've used.I got my Nolo books at Borders and online, don't know who has them in town now.
I'd call Rental Mediation Task force - they're very helpful to landlords as well as tenants, and are extremely knowledgeable and good people to deal with.
California also has a law that only applies to a landlord who lives on the premises and rents to only one person, who is called a lodger, not a tenant. Rental law is identical except that the landlord can enter the rented area without permission, and eviction of a tenant who won't leave doesn't require an unlawful detainer lawsuit. To evict a lodger, you use the same 30-day or three-day notice. If they won't leave at the end of these notice periods, the landlord is supposed to do a citizen's arrest for trespassing, and call the police to have them escorted off the property (no actual trespassing charges are filed). SBPD and SBCO refuse to acknowledge this California law, however. SBPD officers Bruno Peterson and Heather Clark wrote a report that was entirely perjury for a lodger eviction around a year ago, cost me around a thousand $$, suborned trespass by my lodger's parent, who did several hundred $$ additional damage to my property and illegally gave the parent of my adult lodger permission to remove his property.We really need the Rental Mediation Task Force. I'm a physically disabled person and was renting a room to survive, and I don't rent it anymore due to this experience - too much liability caused by vigilante cops, and I'm going broke very rapidly, living on credit cards now. Good luck finding a form!

In our neighborhood, a couple different people are renting rooms to make ends meet. One of the tenants (lodgers?) of one of these rooms was on probation, and violated it, and is now in jail. The owner is trying to evict the tenant/lodger legally, but the t/l is currently in jail. Awkward wording doesn't mean the person is in bed with the devil. It might mean that he's dealing with a complex and stressful situation. It sounds like there are good suggestions above, based on previous unfortunate experiences.

I guess 725 and 744 are renters who feel they should be allowed to live rent free. I know, you miss the easy life at the 'rents' but not the rules - heck you even have rules when you have to pay rent! Sux being an adult, but you'll get the hang of it once it grows on you.

755P - it sounds like a similar situation in my neighborhood (could be the same one). Evictions in general can be very difficult as the law is generally on the tenants' side. Let's all hope it goes smoothly!

The legal aid foundation and the legal resource center are good places to start. Make sure you are using the right forms for the situation or you can get screwed. Even when you are totally in the right it can still drag out for a few months if they want to fight it Going through the whole process the filings alone can run over $500 on top of the lost rent.

@Mitzi - Who exactly are you directing your comment at? Unless something got deleted, it seems like your comments are a little hostile. I don't see anyone mentioning "the devil".... The original poster was just asking one simple question in one simple sentence.... "Where can they find eviction forms"....

D8Vanilla: yes, the comment I was responding to was deleted. I deliberately did not reference the comment #, didn't want to appear haranguing. Instead, I just appear out of nowhere talking about the devil.. the deleted post WAS hostile, I thought, implying the OP was in cahoots with the Devil; I found that crying "devil" overreaches the OP's intent, just as you did. Sorry for the confusion... I'll use the post # in the future.
