317311: You're wrong - something else must have been going on in your case. This is the whole issue in SBPD Kasi Beutel's bogus arrests. You always have a choice. She was putting her hand over the end of the breathalyzer to get a phony high BAC, then forging people's names on blood test waivers (Trombetta releases) - 8 forgeries that SBPD hadn't gotten around to destroying by the time Peter Lance's case went to trial.

311, you might want to contact an attorney. My first reading leads me to believe that it is legal to request a blood test instead of a breathalyzer, but I may be wrong. See first 2 paragraphs: http://dui.drivinglaws.org/resources/dui-refusal-blood-breath-urine-test/california.htm and check out the DMV (I'm too lazy to do so). I did a blood test 20 something years ago because I wanted the evidence. I knew I was guilty; I was .10. I haven't re-offended. I'm not that stupid.

"The initial test only screens for common drugs". So it sounds like we will have to wait for the district attorney to do a real drug test to find out what he was on.

I thought you weren't given the luxury of a blood or urine test without losing your license for a year, at least that is DMV rules.I got arrested for DUI, chose not to take a blow into a machine because they are faulty, and can be rigged by covering a hole in the device,and wanted a blood and urine test taken. Was taken to cottage knowing I didn't have anything in my system for the two specimens.Was jailed and cleared of the DUI through the courts when the samples came back negative. Then I recieved a letter saying my license is suspended for a year because I did not submit to a breathalyzer, per DMV. Police don't tell you that when you are being probed for DUI, BS.In this case sounds like an in house job, will be swept under the rug because the DA isn't going to waste county money on an extensive test.Will be interesting how DMV responds.

I really wish in these instances they would just use a Third-Party to eliminate all doubt. Hard to not wonder otherwise.
