It sounds like both the driver and the newborn baby were properly secured in their vehicle. It really does help a lot especially in this case. Will you update us with new details on the other driver?

I heard it was the Wife of a SBSO, So they probably will follow through on this incident. We need to have video cams on our cars for recourse at the rate of accidents around here.

well it does not make sense to swerve to avoid hitting someone to the extent that you lose control and flip your vehicle. It would be difficult to prove fault, and at minimum it is shared.

recently having had an accident in the City of SB (and CHP is responsible for highway accidents) they only make a report and cite anyone at fault. They do not chase down other drivers and force them to pay. That's the insurance companies job. You have the obligation to get your car repaired regardless of fault and then it's up to your insurance company to recoup your deductible. If they can't (and yes that can happen) then you have to open a civil case against the other driver. Trust me - my car was PARKED legally when it was hit by someone who hit another car and lost control. No one wants to pay for my damage. It's been a nightmare.

Hmmm.....I am wondering about the 7 or so Caltrans cameras that are along the 101. Might we be lucky enough to have that recorded for a period of time? I know this occurred on Turnpike, but maybe one of the previous cameras (or the one on Patterson) could have caught a potential suspect? Just a thought. I would post the link but since I am not a "member" to Edhat, I cannot do so.

If someone else entered her lane and she swerved to avoid being hit by them then that car shares legal fault. It is extremely disturbing that they did not stop! Hoping she has good auto insurance, including underinsured/uninsured motorist coverage and that both she and the baby are healing quickly. How scary! Sure would be nice if everyone slowed down and paid more attention to what is around them.

927/933: Agreed. Although I'd be hard pressed not to swerve if I saw some huge SUV jerk towards my tiny little subcompact. It's an automatic thing.

Yes, legally it is better to hold your position and get in an accident than to swerve and try avoid someone. And if you hit someone you hope their car is disabled so they have to stop. Basically you should drive a hummer as this will help in the above. Modern living.

A co-worker of mine was side-swiped in SB. She followed the car while calling 911. She gave them the license plate number which they ran. They ended up telling her the truck was from out of town and they would not be travelling there to charge him. They told her to have her insurance cover the damage to her car and she could file a civil case if she wanted. So sad that citizens of this town cannot depend on the PD to defend us even when we do most of the work for them.

Wish you the best of luck tracking this knucklehead down. Crazy people out there on the roads. A lady tried to run me off the road on Carrillo near the freeway yesterday, road raging because I passed her and then switched back in to her lane to get on the freeway. No need to road rage and potentially cause a major accident because your ego was damaged for whatever reason.

The CHP is investigating - the case is open - it's very difficult to catch the responsible party in situations like this so posting it in an open forum is certainly a good idea. I hope you get closure soon and I hope your family members are okay - there are callous and uncaring people out there - don't let them get you down.

Sad! Hope they're both okay!! My husband was side-swiped by a car a few years ago on the 101 here - the guy also hit an MTD bus - CHP never found the guy! Not sure if they even tried...but luckily no one was hurt in that accident!
