Unless the driver forced her to get drunk, take drugs, and car surf I do not see how he is more responsible for the outcome than anyone else. He was drunk and high as well so the argument that her decision making was altered is not a defense. Adults should be accountable for their own actions. If that excuses her actions it excuses his as well. I don't know any of these people but if grown adults decide they are going to partake in these activities others should not be held accountable for their actions. Yes he was driving she climbed on the hood both were intoxicated, tragic accident caused by many bad decisions but certainly not murder. He should talk to Attias' lawyer maybe they can get a not guilty verdict since it was obviously the drugs that made him do it.

Many years ago, a friend's 16 y.o. daughter demanded her date take her home because he was looped and being a jerk. She had the right idea, but it was fatal.

How does the witness know that the substance in question was specifically "cocaine"?

What a waste... a lot of bad decisions lead up to the moment when she decided to snort the cocaine. However she was raised, her friends, a lot of people responsible...

Sounds like the passenger didn't want to be part of it. The other 3 were plain stupid; the surviving girl should be held responsible too. Can't understand why they didn't call 911; Montecito Fire, with paramedics, could have been there in 5 min. Can't even imagine picking the dead girl out of the bushes and hauling her to Cottage. Paramedics could have taken care of the other girl.

There is no legal duty to rescue someone.

Stupid anyway you look at it. She was a grown woman, capable of making her own decisions and she made some really stupid ones leading up to the incident that resulted in her dying. She wasn't an innocent victim here. Same goes for the driver, made horrible decisions. Unfortunate & stupid.

Stupid, stupid, stupid. What a waste.

Wonder if the person who saw them surfing on Arellaga prior to the Foothill caper called the cops.

"Cocaine is a hell of a drug."

Rick James

I told you when the story broke originally that it would be involved... Seems my hunch was correct.

I don't think there's anything FUNNY about someone dying from intoxication. Also, have those of you who ARE being crass considered that she may have been too far gone to think straight and that the person driving the car was ultimately responsible for the death?

@316579: Wait a minute! Whatever she chose to ingest, HE was the one that drove the car. The story says she fell off earlier in the night and he STILL kept up with the stupid game. She would be alive today if he had been a big enough man to say, "Get in the car, I'm taking you home."

The fittest have an intact "what-happens-next" connection in their brain and recognize a bad idea when they hear it.

She choose to pollute her judgment with intoxicants. Then in her chosen state of mind, she chose to do something dangerous. This was her choice.

The primary cause of poor judgment came when she first chose with rational judgement to ingest the intoxicant, with the known outcome only being one thing - altered judgement.

What happened next was well within the range of expectations of outcomes. Get high. Act stupid. Live or don't live to tell the consequences.

Isn't it time we backed up assigning responsibility to that initial choice to get high, rather than demand pity for choices made after willingly crossing that initial threshold? Getting high makes you stupid. Some times this is funny. Sometimes this is tragic. Know your odds ahead of that first choice to get high.

The survival of the fittest starts occuring in your middle and later years. Being in the wrong place, at the wrong time, with the wrong person, was just too many strikes against her. How old are you, 531 and 510?

I wonder if you can sue someone that admits to witnessing an illegal act that resulted in the death of someone. Any lawyers out there with some free time?

It is EXACTLY the survival of the fittest. Not crass. Just facts.

COMMENT 316631 helpful negative off topic

2012-09-05 03:32 PM

I don't think it's so much survival of the fittest (pretty crass and unfeeling if you ask me) as just people who don't have enough confidence or are in enough pain to turn to drugs and alcohol. It's easier to say they're dumb or that the girl who died somehow deserved her fate, but really that's not any more true than anyone else "deserving" to be taken out on a day they do something the rest of us would consider stupid.

It's a sad story and yes, it's not something most people would do. But that doesn't mean anyone DESERVES to die a horrible death.
