As far as I know, you are allowed to be topless (even completely naked!) as long as it isn't for exhibitionist reasons. A woman won a lawsuit allowing her to garden while stark nude because she proved she wasn't trying to cause a scene and was truly just doing it because she enjoyed it. Now try telling that to a police officer :)

Since that bit of beach runs east-west, I'd assume that he was 1.5 miles EAST of Hendrys (between Hendrys and Ledbetters, not More Mesa. But really, who cares? I'd welcome seeing nature, even augmented nature on a beach walk.

As a kid I used to love all the nude ladies on Butterfly Beach and out by Rincon. Too bad the right wingers had to ban them. The weirdos were always a problem, I suppose, but worth the trade off, in my opinion. I saw one of my high school teachers playing nude volleyball once. Pretty cool stuff.

Oops, OP here. I meant west of Hendry's parking lot, not south. And it was inbetween Hendry's and the Hope Ranch parking lot so not in More Mesa. For what it's worth, shortly thereafter I saw a woman walking in a skimpy red and black lace bra so there's something in the air!

I would like to try and answer the question. Based upon everything I have heard and read - Nowhere in Santa Barbara County is it legal to be nude outside. The definition of nude is too long to go into but a topless women would be defined as nude. As many of you know, in the past many SB beaches had many nude people on them. It was never "legal' it was just not something the police went after unless some other "problem" was happening. That is no longer true.

No one is offended or aroused by men baring their breasts wherever they want to but for some reason women's breasts are not allowed for public viewing. They are just mammary glands, folks! Many of us use them to feed our children and I, for one, always feed my infants whenever they were hungry and wherever I happened to be.

I think the law is that it isn't permitted. There used to be 3 or 4 beaches that were mostly nude beaches, because there was no one close enough to complain. They were remote enough that you had to hike to them. Then we let people build all over the damned place, and now, no place is remote enough to not get complaints, so no where is OK to go nude anymore. Damned shame. Feels good to swim and lie in the warm sun as nature intended.

Anyone 'walking' down the beach Topless isn't looking for privacy, they are looking for some attention. I don't have a problem with nudity, I think most bodies are pretty awesome. Going topless in Europe has gone out of favor and style these days, especially with the French who kinda started it all...go figure.

I'm not sure it's against the law and pursuing it would not be effective, with pictures or otherwise. Ignore the woman, assuming she wasn't doing anything offensive that would raise alarms with clothes on or off. It was a shock to you, you are not used to it. We are 'free thinkers' here because the Constitution allows us to be, but that can step on the toes of the more conventional person. Not all Europeans are nudies (I really can't see this in chilly England), and so let it go as they say and if you do snap a picture of her 'impressive boob job' you might find yourself on the other end of lawsuit yourself. Freethinkers, whoever gets there first.

If the woman wasn't hurting anyone why should the assumption be that she was, or should be, breaking some law? If she looked good dressed as she was, smile and say good day. In that general area I have seen a woman swimmer who swims topless. She keeps her towel and a top against the cliff rocky area. She appears to be a healthy, well tanned 60+ years old. I applaud this. I laughed aloud when I was passed by a 40- 50 year old male jogger in running shoes who carried a pair of shorts in his hand. Seeing a male whose body parts were jogging up and down was an amusing sight.

I didn't get the impression the OP was offended, just curious. Why all the snarky retorts that he (?) should mind his own business? Isn't that what he's doing? I agree with Aqua, anyone walking down a non-nude beach topless is welcoming attention, and it makes sense since the walker obviously put some effort and risk into those boobs. Unless the law's changed, pubic nudity is illegal here; a few years ago there was a widely publicized "sting" on a nude beach near Summerland, with cops arriving from land and sea. Gee whiz! More Mesa beach is still holding out, and the Europeans I know go there. They live here and aren't into shocking people. By the way England is not considered Europe by English or Continentals, over there.

I been a Mesa Beach goer for 36 years. Mesa Lane about 20 years ago had a lot of topless women typically a few hundred yards West (Not North) towards Hendries. Then there were a few years of More Mesa nude demeaner. I been to Mesa Lane beach 50 times this summer for a 30 minute swim and there are topless girls / women periodically. Not usually right where the lane goers towel out. Seems really mellow, they are enjoying getting their tans and not overtly pushing it into other folks or families. Most lay open air and cover up for their beach swim. No big deal. Most are a way's away from the staircase btm. I heard a radio show that talked about the last 200 years of brassiere history and that the bra could be restricting / interrupting lymphatic and other body fluids moving just inside our skin. I am hoping it stays mellow and does not get to a exhibitionist, truck stop nude beach like a few I have heard reports of up north. Where people go for casual hookups.

Way too much concern over other people's behavior that doesn't and shouldn't have any effect on you. People, get a life. I think it's ridiculous for us to impose clothing requirements that apply inequally to each gender. If it's ok for men to sunbathe topless at the beach, then so should it be for women. PERIOD. The rules about covering the private, genital parts are ancient, time-honored, and appropriate anywhere other than in the privacy of one's own home, or at a nudist colony. Just stop trying to dictate what other people are allowed to do.
