To have a blood alcohol level of 0.23 at 10:30 in the morning is evidence of a serious problem. That is vodka for breakfast, going down the tubes fast. Hope she gets treatment before she or someone else dies as a result of her drinking.

833, actually that's not true at all. A DUI without a previous record is often treated leniently. Most of the time there ISN'T any jail time for a DUI (first or second or even third) if there is no injury or serious property damage. It may not be ideal, but that's the way the laws and courts work. So, no. She's not getting a break and none of us in her same circumstances would be doing serious jail time for this.

Noozhawk has a more comprehensive story. Pretty likely this has been a tough experience for Falcone who most probably was coveting running again next year, if not for mayor then for council. First offense, no injury, minor property damage, plus a crowded jail — the scarlet letter of A for alcohol plus the $ will be strong punishment.

It's a small fine ($2356) for her anyway but the 3 years probabtion will be lovely on her record. DUI's happen a lot more than people think. Her blood alcohol was high especially for that time of morning. Hopefully she learns her lesson. The DA wanted jail time (15 days which would have been 7 days maybe) due to the high BAC and accident. Getting a DUI sucks (no I haven't had one but I know plenty of people who have) and it's expensive.

Surprising there isn't a suspended sentence of the jail time though, meaning she serves it if she re-offends. That's common, as is no jail time.

Previous City Council candidates (I can think of two in recent years) were not elected, likely due to their prior DUI convictions. I would suspect Iya's political future is also in jeopardy as a result of this. I do think higher-profile people are treated differently by the justice system. As the DA points out, this would typically warrant a 15-day jail sentence.

Iya did not have a political future even before this because she already played out her political past. Wish her the best recovery for where ever the rest of her relatively young life takes her. Though who knows if Iya no longer spends tax money like a drunken sailor, she might have a political future here after all.

A drunk driver hit my and my neighbor's parked cars last year. She ran but left her plate and they busted her. I went to the trial, and she was offered terms much more lenient than these. Basically, they dropped the hit and run charges and put her into a first time DUI program, which mean that the DUI would be dropped if she didn't screw up.

@834 first time DUIs are only treated leniently in Santa Barbara. California has different penalties in every county. SB, Beverly Hills and Glendale are some cities where people get off easy. It is absurd and unfair. The fines and penalties should be standard for the entire state. @891 9 months is not twice the time of a "normal" person to have in DUI class. Anyone who has a BAC of .2 or higher gets the 9 month program in Santa Barbara. BAC of .08-.19 get 6 months Second time offenders get 18 months. A .24 is serious especially that early in the morning. Just because she WAS a public figure does not qualify her to be speaking on this issue. She needs help. Mandating 4 public speeches on the topic as part of her sentence is totally rediculous. Jail and community service would be much more appropriate.

I object to ANYONE getting behind the wheel after imbibing even the tiniest amount of alcohol. Driving impaired is no joke, especially since we live in a town where there are too many cars, too many people and so many compromised views at intersections. I think it's a shame Iya didn't get a little bit of jail time. Perhaps then she could have become an advocate for better jail facilities or something----some outcome where her bad judgement and blatant carelessness would then have been converted to a learning experience for her, and some benefit for the community. Drunk at 10:30 in the morning? I hope Iya dries out now.

I have to wonder what is so wrong with her life that she is that drunk that early in the morning. I am not advocating being that drunk, or even having a drink that early in morning. I, along with so many of you, feel that it seems that she got off fairly lightly.

Bottom line here is she plead no contest and seems to have gotten the standard sentence for the offense she committed. It's nearly the same sentence my ex-husband got for practically the same circumstances. She got much more DUI education time than he did. It cost us a fortune and was the final blow to our marriage. I hope she is getting the help she needs and that this will be the last time for her.
