@457. Correct Kristine Mollenkopf is an attorney, but this story is about the plaintiff, Jean Mollenkopf who is not an attorney......

@442. State Bar membership does not show Jean Mollenkopf as an attorney.

How many subcontractors were lied to over the years by Mollenkopf? Wasn't she his attorney thru all sorts of subcontractor disputes? Melchiori has taught his employees to believe in his web of lies and then he put the screws to them as we'll in the end! Shame on you MM

Super sleezy if it's true he divorced to hide money. Any way to go after the wife? Or, at least discover her assets and publicly disclose their shady dealings?

Isn't this criminal? Why hasn't there been any criminal charges filed against Mark for his shady business practices. It wouldn't get the money back but at least the poor subs would get the satisfaction knowing he is being punished for what he did.

So Melchiori really did collect, at least something, from Chapala One, yet still crashed and burned? How sad. How wasteful. How possibly evil. How much in atty. fees. Guess he may be as bad as he appears. I agree these employees made a very poor decision in which emotion must have played a large part. "We were to be paid when payments came in on the Chapala One case,” Mollenkopf said, adding that *the payments came in* but the loans to their 401(k) accounts were not paid off." [emphasis added] And not just $5.8 million: "Melchiori was awarded $5.8 million in damages, which was the bill unpaid by Hughes, and delayed payment penalties and attorney costs, which are expected to be an additional $6 million." http://www.noozhawk.com/article/051111_melchiori_prevails_in_chapala_one_civil_case/ I'm still wondering how much of the judgment was actually paid to Melchiori Construction. I rather doubt it was a lump sum. Anyone know? Curiouser and curiouser. A much more public and litigious burnout than R.P. Richards, I do believe.

actually it looks worse. it said she took 50k out of her 401k, so she now will pay taxes on the 50k. and there are others who did the same..... i hope they figure a way to get their money back.

And if they can't repay they will taking it as a distribution and paying taxes. Including a possible 10% penalty for taking it before 59 1/2.

Either he is a really smooth talker or these people were desperate to keep a job in this employment climate. Either way, borrowing from your 401K to meet payroll without any collateral seems to be really foolish. The worst part is that now these people have to repay the loan to themselves, with interest, without having a job. Nightmare scenario.

Shameful. Too bad the good name of Melchiori Construction has been taken down by the son. And I hope if he's hiding money in his 'divorce' that it's found and these people are repaid.

Not a smart move... didn't they file for bankruptcy? So she probably won't get her money back.

well, duh. payroll is more important than 401s and if you can't make payroll, well, it's not a good sign
