This reminds me of the crook who was being chased by cops on foot and while trying to jump a small fence, fell and hurt himself. Long story short, the "crook" was able to sue the homeowner because the fence was "too short." He ended up collecting millions! When is this nonsense going to end?

Attorney A. Barry Cappello will most likely reap the largest portion of this $4.8 M settlement by his legal fees. And where are those funds coming from? You and me, the taxpayers.

And people wonder why some folks in this profession have a negative reputation.

The settlement is not going to heal the victims nor bring the deceased back to life, nor punish the defendant, nor cause the Sheriff's Dept to change its policy.

Has justice been served with this civil verdict?

The cop got on the freeway going so slow that the two cars (the victim's parents in the first car, and the victim in the second) in the #2 lane had to move to the #1 lane. Then, the cop put his lights on. First car moved back over because he thought he was being pulled over, but second car didn't have enough time and was hit.

Lots of questions remain. Why wouldn't the cop get on the freeway with lights and sirens if he saw the wrong way driver?? Could have, and likely would have, changed everything about what happened. Bad decisions were made, bottom line.

Hey folks, Monday morning quarterbacking is real easy. The true victims in this situation are obvious and we all send out our prayers and good wishes to the families injured in this action. The police officer is not at fault. Things happen quickly, freeways are crowded..mayhem just happens and happens fast. Insurance companies roll over on suits like these for simple reasons like: Most jurers that have the time to sit for a trial and are actually chosen, are not very capable of making good decisions based upon fact. Most competent people try real hard to escape jury duty when they can..and the ones that don't get escused get challenged by Barry and thrown out so that the dumb rule the jury. The ambulence chasers like Capello exploit this for their own personal gain. It does not bring back the dead or injured or make anything right. This is such a tragedy on so many different levels.

@643, they passed a cop who had no warning lights activated. It's very common to see police and CHP cars stopped at odd places along the road or driving in a way that would be unusual for civilian vehicles. A car moving slowly along the shoulder with no warning lights might be driven by an officer who's just re-entering the roadway after writing a ticket or picking up debris. Or maybe he's looking for something on the shoulder.

When you're on the freeway and you see a cop car or emergency vehicle stopped or moving along the shoulder, you're required to move over and give them an empty lane as a cushion. You can get a big, fat ticket for failing to do that.

STRAY, you didn't read the article to the conclusion. The last paragraph on Noozhawk reads, "The statement said that the vast majority of the settlement would be used to pay for the lifetime of medical expenses for the Arredondo’s two daughters."

This is sad all around. But putting the money aside, what I've taken away from reading this one article is that cops sometimes do things that don't make sense to the average citizen, and this time, what the cop did was confusing enough to exacerbate an already bad situation (the drunk, wrong-way driver). The court finds that the deputy did something wrong.

No one will ever convince the cops-can-do-no-wrong crowd that cops can, will and do, do things wrong. Until, of course, something happens to them or theirs.

Looks like the cop just didn't think it through and made a mistake. Happens all the time everywhere. I suppose to the every-man-for-himself crowd the solution would have been to the daughters who were injured, Hey good luck with that. What do you want from us? Pull yourself up by your bootstraps and don't bother us with your problems cuz it's every man for himself.

I guess that's why red states take more federal tax money per capita than blue states, cuz they're so into every-man-for-himself.

The way the article is written, it appears that the county is going to pay this $4 million award. Doesn't the county have insurance to cover this kind of thing? If the county is indeed on the hook for this $4 million travesty, where is the $$$ going to come from? County officials have been slashing personnel and services all over the place.

No wonder the U.S. legal system is regarded as a joke in much of the world.

Rather than arguing about the jury award, why aren't we asking why we can't keep drunks off the road? Do we need to equip their cars with that breathalyzer equipment? Pass a law saying that anyone that loans them a car is also liable for any damages? Make bail so high that a drunk with multiple convictions has to stay in County jail until the trial is over?

Clearly they are not capable of obeying the law as most of these guys have suspended licenses and are not supposed to be driving anyway. I hope he serves the full 10 yrs in jail. I approve of this use of my tax dollars.

779 - you make valid points. You don't know this because you're not an idiot who drives drunk but each year the laws subtly change - the fees get higher, the sentences get longer and it is more difficult for these people to get their licenses back. There is no excuse for driving drunk ever. The laws need to get a lot tougher - that is certain.

God Bless Deputy Jeremy Rogers for putting his life on the line, putting himself in harms way by getting on the freeway and trying to stop a murderer with a 4,000 pound weapon. Thank you for what you do and to all deputies and officers who put themselves on the line every day.

Attacking lawyers for doing their jobs well is small, petty and one sided (until YOU need one, of course).

The settlement will be used to support the injured survivors -- which is a good outcome.

The sheriff's office needs to train its officers to properly handle situations like these to prevent them in the future; another good outcome, right?

Richard Rodriguez had been taking illegal drugs and drinking alcohol before he got behind the wheel.

How is it that the County is liable for Mr. Rodriguez bad driving? What's going on with with our County Counsel giving away our hard-earned tax dollars to sharks like Barry Capello?

There's clearly something very very wrong with our legal system. I'm pissed!

Holding the county liable for a guy getting wasted and driving the wrong way down a clearly marked freeway is just plain wrong. How does that advance our society as a whole? Thanks Barry. Great way to improve the public's view of the legal system.

A lot of the posters are "Monday morning quarterbacking". The fact is that no one knows exactly how things happened because there are a lot of perspectives to take into consideration. What did the 911 tapes say? What did the dispatcher tell the deputy? What exactly did he see and how did he perceive things as he was reacting? Could any of the posters have reacted as well as the deputy? And a simple fact that many people cannot recall the exact events and how they transpired because they are too stressful or traumatic.

In my opinion, Sheriff Brown's statement was correct. Law enforcement officers did nothing wrong, the idiot behind the wheel did not care about anyone or anything. So even if the County has insurance to pay for this mess, their insurance rate will probably go up which will affect the County's ability to serve us.

The deputy got on the freeway suspecting a wrong way driver, but made no effort to keep the innocent people on the road out of harm's way.

Why not turn on his lights and sirens so they would pull over? Why not warn them with the bullhorn built into his car? Why not at least keep his car between the innocent people and the wrong way driver, instead of letting them pass him?

Yes, Sparkey, he did something wrong.
