There is no way this guy will be convicted- unless he has the World's worst lawyer. This case lacks any reliable witnesses and has no physical evidence, no video recordings, nothing. The busboy admitted he saw no sexual contact between the girl and the accused. He only saw the girl crying. This case should be dismissed before the taxpayers blow thousands of dollars on a trial that will result in a not guilty verdict.

518 probably thinks it's the girl's fault. Why else would you suggest that we shouldn't bother prosecuting someone accused of a crime? Or maybe that's what passes for justice these days?

Who knows who's telling the truth? The fact is in a criminal court of law the defendent must be convicted beyond a reasonable doubt. This story was in Edhat last month. The busboy admitted to PD that the room was so dark and crowded that he could not see very well. When he turned his flashlight on the couple he say the girl crying but never told the PD he saw the defendant touching the girl under her dress. Of the hundred or so people in the room not one person other than the busboy saw anything. Security saw nothing. The girl's friends saw nothing. The girl had been drinking. A good lawyer would get this dismissed before it got to the jury.

518, so any case of sexual assault in which there's an initial lack of evidence should be dismissed?

Uhhhh, no. And I'm glad the law doesn't work like you think it does/should. There's more to criminal investigation and charges than video tape and "reliable" witnesses.

And there's likely a lot more to this case than what has been reported. We don't get to see the entire criminal report the police made nor do we know exactly why charges are being filed. There's more to it than just a busboy NOT seeing something that someone was accused of doing.
