Billy, The Dead Dog

2013-01-23 12:00 AM

Whatever happened to the good old days when a jerk who did not want a dog to approach him simply kicked if?
Of course, I am being facetious, and darkly so. But really, unless it is giant attack dog, who SHOOTS a dog in 2013? The police in a drug raid, but that is about it.

Another thing. Wild pigs that they were allegedly hunting are VERY aggressive. How could they not have the courage to figure out how to deal with a barking dog when they were hunting an aggressive animal with tusks? Chances are they might have been wearing protective clothing, maybe even had bear spray or other items for protection. I am starting to think their story does not add up.

If a dog is thinking it might need to bite, it growls. Barking is communication. You'd think if they are hunters they might know the tiniest thing about animal behavior.

So sad; sorry for your loss to Billy's family.

Traffic Collision Found Over 154

2013-01-22 10:11 PM

CHP Officer Christopher Terry has now been quoted as saying:

"The reason we found it today is since we hadn't found anything last night and we kept getting calls about it second hand from his brother, our sergeant had a couple units come up here again and go very slowly looking up over the side of every crevice that we had"

Why the heck did they not do that LAST NIGHT??

Regardless as to if this was a DUI or not, how would you feel if you were involved in an accident, trapped in your car and visible from the side of the road but no one tried hard enough to find you until the next day.

Was this pay back because he didn't call 911 himself or due to his priors? I sadly almost hope it was because if not, it means all of us will get the same level of search if involved in an accident.

And please don't forget the man whom was seen crawling disoriented on the freeway Jan 1, searched for less than half an hour, then a man was found dead in the area several hours later.

I don't think that seems like a good idea just to have a empty house there. What about the gang activity we have had there or if an older person gets hurt or needs help. Not everyone has a cell phone.Who cleans up the trash and makes sure that there is no broken bottles or needles or drugs around the area. How about the upkeep of the bathrooms? How about the people you call to reserve the tables? This really isn't safe for anyone. Heck rent out this house and use the money to keep up the beach. Does this mean ther are no rangers at stow park either? How safe is this! Wait until someone sues them.

An unsupervised 'pet' (domesticated animal) is as predictable on a trail as a supervised one. It's not at all the same thing as a wild (undomesticated) animal.

Some have been well socialized to humans and other dogs by their human companions, and others have not. In neither case is it the fault of the dog.

I agree with you, though, that it sounds like the hunter was distraught about this unfortunate situation.

Picture Styles are applied to the JPG file and its preview not the RAW file. When shooting RAW the image you see on the back of your camera is not the RAW file but the JPG preview. This JPG preview will also be the first image you see during download and import but is discarded once the heavier RAW file has been downloaded and converted. Ever noticed how the image changes shortly after import? It's subtle and takes place before the histogram is generated.

Billy, The Dead Dog

Just a reminder, both the hunters *and* Billy's owner were distraught over this incident, and reported it together, without confrontation.

Obviously the hunters felt badly about it. That Billy's owner did is more than obvious.

Hindsight is, well, hindsight. I'm sure the hunters wish this hadn't happened. I am a little uncomfortable that the hunters were coming down the trail with loaded weapons, as a hiker myself.

We truly need more education on how to read dogs' behavior.

How very, very sad for the owner of this sweet-sounding dog. Sympathies from a fellow rescue-dog owner! And Shorebird, had Billy been on a leash he might still be, probably would be alive (a dog on a leash can sound and seem also aggressive) and had the hiking hunter not been carrying a loaded gun, Billy surely would still be alive.

Bobcat's Chicken Dinner

2013-01-22 07:51 PM

094, as I said, I have no problem whatsoever with your protecting your animals, and dealing with the actual responsible party/parties, should a neighbor's dog kill your chickens.

But again, it's not the fault of the dog, and the reality is you *are* punishing the dog, fatally, if you make that decision.

I don't disagree that if you can't keep your animals contained, then you don't make the definition of responsible animal 'owner,' and shouldn't have them. With the exception of an accident, as accidents do happen to us all. But the animals shouldn't be the ones to suffer for the irresponsibility of their human (sometimes so-called) caretakers. Especially not with their lives. There are other recourses.

Having now seen the photos of Billy, as well as his write-up here on EdHat as dog of the week, I cannot fathom being afraid of him, and I say this as a 5'6" woman, weighing about 140.

Dogs often bark at a stranger. This doesn't mean aggressiveness or a precursor to attack.

For those who don't know, your best recourse under these situations is to not look at the dog (considered by dogs as aggression), and basically ignore them. If a dog is truly aggressive, that's another story. But a barking dog is most often just that: a barking dog.

"Both the hunters and trail runner then hiked out to Upper Oso and drove to the Santa Barbara District office of Los Padres Forest near Sage Hill Campground to report the incident. According to District Ranger Pancho Smith, the situation was not confrontational; rather, one in which both parties appeared to be completely distraught."

Billy, The Dead Dog

2013-01-22 07:04 PM

After seeing Billy's 2010 Dog of the Week article, I am even more saddened.

"Nobody rugged enough to hunt the back country should have felt threaten by that dog."

Yes. It's difficult for me to believe they did. Not that I think they were lying; I think they truly felt threatened, but shouldn't have been. Billy lost his life as a result.

378, that's a very sad story. However, what do you propose? That no one have dogs? The infections were not the fault of the dogs. Personally, I would advocate for more education of people with dog behavior (especially children, who are prone to approach dogs they don't know -- which should be taught by their parents; however their parents usually don't know themselves), as well as education for dog owners.

I'm a volunteer with one of our local dog rescue groups, and there's no question in my mind there needs to be education on both ends.

As someone said above, had the dog been on a leash the owner would be taking more snaps of his beloved pet. When I was very young my father had to kill a neighbors cat and send in "parts" in order to determine if the cat had rabies - it was one of the most horrible things I've ever witnessed. God speed little Billy and I hope you get to chew, bark, jump and run wherever you are because Santa Barbara is a terrible place for dogs.

Billy, The Dead Dog

Pretty much any dog can bite a person and cause a moderate wound. Did any of you hear about the woman who was bitten by her daughter's dog (causing a small cut), contracted a bacterial infection from the dog, and then lost both legs and all of her fingers due to the infection stemming from the minor bite? Just saying. Some people don't appreciate being accosted by uncontrolled animals, big or small, when there are potential threats from all sizes.

Let's say he wasn't impaired ... he still has had 3 DUI's in 3 years. Please, why isn't this man in prison? yes, impound his vehicle, sell it, and use the funds to help pay for the expense of his incarceration. If he continues to be at large, I've got a buck that says he's caught DUI again within 24 months. Not that it takes him that long to drive under the influence, just that he'll get caught again. When are we going to get SERIOUS about DUI?

Good grief. I'm a woman, 5'6", 140 lbs and there *no way* I'd be afraid of this dog.

I am so sorry Billy had to die because two hunters had no clue how to assess the situation, and respond accordingly.

However, I have a lot of experience with dogs, and acknowledge that not everyone does. I'm sure the hunters felt they were doing what they had to do to protect themselves.

2013-01-22 06:00 PM

As has been said before ... None of us were there so we don't really know....but...what I do know is this...

Anyone that ventures into the back country with a dog had better have total control...some (very few) can maintain voice control the rest had better use a leash...and this is why..

Should your dog run into wild boar, cats, or bear..the ensuing encounter will not be pretty! In the event they run do you know where that will be? Yup, right back to you....are you prepared to handle what comes next?... I doubt it....

I don't know what the law is here but in many places dogs seen running deer are shot on sight!

When you take your favorite pal hiking with you...you may not be doing it a favor....

Condolences to the pet owner, nonetheless !

We weren't there, and I personally have missed/ seen later, cars over the side of moutain/154 area. It's no small area to try and find something. They weren't going to shut down the pass and do a walk through regardless of if it was DUI or not.

They probably assumed since he talked to his family and said no pd that he wasn't gravely injured.

A car upside down, is going to look black. Add foliage, nighttime, etc. kinda hard to find. I say, good job glad they found him and he didn't hurt anyone else

Exactly *where* does it say the dog had the person was on the ground and was attacking?

'According to the hunters, the dog began to bark at them and appeared to be acting in an aggressive manner. In response, one of the hunters began to back up and stumbled, falling down. He later reported to Sheriff’s Deputy David Valadez that the dog continued to bark and act in an aggressive manner, frightening the hunters enough that one of them took aim and fired.'

Right, nowhere.

The dog was barking, in a manner the hunters interpreted as aggressive. Period. The ignorance is yours, 219.

302, I'm so sorry for your loss of Billy. I can't imagine how difficult this must be for you. You're right, discharging the gun in the air would have been the appropriate action if they were that frightened.

But I do wonder why if there were multiple motorists reporting an impaired driver in Summerland, couldn't he have been stopped before the 154?

He was arthritic and I did not have his card on file, because my former step dad needed all the files for the dogs that were groomed there, for the divorce. Well he turned around and bit my finger, and his tooth went clear through my finger. As I shook my hand to get him to let go, he whirled around and bit me in the neck. He was on a grooming table and I was trying to keep him from falling off. I am lucky to have very quick reactions, because he only caught the skin on the front of my neck. P.S. Just read all the comments re touching/untouched. A photographer is like any other artist--writer, dancer or actor--The best work they produce moves us, but no matter how good it is, it also comes across as natural and effortless.
That is why I love these pictures. You did not over-process them, but you put your stamp on them when you applied finishing touches to RAW files. The temptation to so many is to over-do the editing. It makes images that would otherwise be beautiful appear as if they went through a software blender. The inherent beauty is lost along the way. It's like a powerful play whose stage becomes too crowded with klunky props. It ends up being impossible to appreciate the acting.
These are great!!

One of my best animal friends is a pit bull terrier who has never posed a threat to anybody, who nonetheless is kept on a choke chain outside and under voice control at all times. Terriers of any size are attack dogs. Getting gooey about it doesn't advance the truth one bit. And throwing politics into it is just lame.

I now say without a doubt that this was a HUGE over reaction by the hunters and they have NO excuse what so ever.

Its also the reason that many people should not be allow to own guns... this dog could maybe, maybe cause a few stitches, yet this brainless, weak man shoots him...he could have shot in the air and scared him, he could have used his rifle to hit him but instead the weak man, falls on his butt and as weak, scared, feeble minded men do, he over reacts...

I am utterly appalled.

A dog like this does not maul or seriously injure a man out in the open (i.e. not being cornered). At worst they nip. Usually yelling at them or tossing a rock or piece of wood near them scares the bejeesus out of them. Period.

Traffic Collision Found Over 154

2013-01-22 04:51 PM

Nice Press Release from the CHP.

There are two separate topics here: 1. If he was DUI and his potential negligence and 2. Why did it take them so long to find him.

With the phone number of the cell phone from the reporting party, they could have pinged it and got his GPS location. The only exception to this would have been if his battery died between 4PM and 5PM.

They didn't find the vehicle until 15 HOURS after it was reported.

The car was just 20 feet off the road, and was visible from the side of the road. If any of the responders got out of their car and just looked with flashlights, they would have seen him. You can see this in the linked picture below.

Maybe it is a bad guy with priors of DUI. Regardless, If you were involved in an accident, you would likely want to be found more quickly and not have to spend the night injured in your car. Anyone with more serious injuries could have died waiting.

Also, the Press Release states "involved Toyota Prius had been earlier reported by motorists as being driven recklessly on US-101 northbound, in the Summerland area."

Really? If they are certain it was the same involved Prius, identified with license plate number, then why did the CHP not locate and stop the car with all that time and distance between Summerland and the 154?

And how will they determine he was DUI with prescription drugs if they are testing his blood 15 hours later? That would have to be one massive dose. He could also claim that it was in his blood due to pain from the accident and he took it post crash. All these things would have been resolved if they just got to the accident site sooner.

2013-01-22 04:46 PM

I am the owner of the dog that was killed. His name was Billy and he was by far one of the kindest dog's I've ever known. He was a terrier. I truly wish that Mr. Ford had done more research before writing and publishing this article. There are several inaccuracies in this article, most importantly Billy's size. He was not 65 lbs. But rather 50 lbs and only 1.5 feet high. There were two hunters there and many other options besides shooting Billy. I believe that the hunters should have used their heads could have done several other things to protect themselves, including discharging the gun in the air or kicking the dog away. Billy has NEVER bitten anyone in his too short life and would have stopped barking, because that's all he was doing, if the hunter had used another course of action. What would make me happy is to know that people in our community are aware that there are hunters in the back country and that something like this can happen.

Eddie, I guess we are disagreeing on semantics.

To me, a pet is an animal controlled by humans. An animal not under control is wild. If an animals owner is not around (the hikers had no way to tell where the owner was) then that animal is not under control therefore wild. If you disagree that is fine.

I have been around dogs my whole life and have enough experience to know that they are unpredictable in unfamiliar situations. Dog owners who think they sweet dog can not strike fear in an otherwise normal rational person are mistaken. Bread is irrelevant, some of the most aggressive dogs towards strangers are jacks and terriers.

Recently an eighty year old woman was mauled by two pit bulls as she was merely walking down a residential street. Now THAT'S when it is okay to shoot. But where were you, big macho man? Sounds like the guy just used a barking dog as an excuse to shoot an innocent animal. What, didn't you kill any pigs that day? Were you bummed out? When you saw the dog you turned into little girl, and fell down. Your fault. Klutz. That sounds like peculiar behavior, and the dog knew it. Why was your gun still loaded? That's a public trail used by everyone. Anyone who defends the idiot with the gun is ignorant, to the tenth degree.

Dillydally, where did you develop your theory that a dog on a trail is not a pet if it is out of sight, but instead a wild animal? I am OK with that being expressed as the way you FEEL when confronted with such, but stating it as if you are speaking universal truths is off. A dog is domesticated animal. A dog unsupervised can exhibit threatening behavior as result of its animal instincts. That may be to run, it may be to charge. There is nothing about a pet dog that qualified as a wild animal, though one can fee AS afraid as if they encountered a wild animal.
Hyperbole never helps any of these posts.

Traffic Collision Found Over 154

Answer: We seize the cars of chronic inebriates (or penalize those who let them use cars) and give a life sentence after the fourth infraction. If you've done it three times (or even after two), and then do it again, you don't deserve to live in polite society with the rest of us, threatening my kids live. It's that simple. You may have a disease, need help, want to change, blah blah blah, but I don't deserve to die because you got on the road. Get a bike. No, maybe that won't even work. P.S. Kudos to the family for turning him in.

I do not hunt, have no desire to own a gun, own a dog, own many leashes, am semi liberal and...if I felt like a dog with no visible owner and no one calling the dog off...I would probably wish I had a gun too.

Dog owners have to recognize that their rights to allow their dogs to run free do not trump the rest of the world.

No, no photos of the dog are needed. Have no doubt he looks happy and sweet, but not relevant and no excuse for any return to photo-posting-mania.

Points for use of "dogmatically" in literal sense and (I assume) as a pun.

I realize I should know better than to weigh in on an animal-related issue here. I understand that some get a bit, can I say "obsessed," but much of this is a bit scary, not just the anger, but the "Dad" story. Yikes!

I think the jokes are pretty funny - and I'm a woman. Mellow out, people. As for the incident, it's hard to know since we weren't there. apparently, the dog was farther than the length of the shotgun, so it doesn't sound like it intended to bite. Dogs that bite generally go right in and bite. They do not usually stand and bark, then run in and bite. You'd think hunters would have some experience in understanding animal behavior...
My dog might very well act just the same in that circumstance. I am still training him, so I try not to let him off leash where he'd encounter a situation where he may feel defensive.
Congratulations to both parties for being responsible and going to the authorities. Let's all try to give each other credit for trying to do the right thing, but being human, sometimes making mistakes.

I have owned dogs that were considered extremely friendly that have acted in an aggressive manner when they felt that either they or myself were threatened. Dogs are not always predictable. In hindsight, the hunter probably could have taken different action but he wasn't thinking, he was reacting to what he perceived as an immediate threat.

No, Dan, we will not be able to judge from a nice little photo taken of this dog, and it's not relevant. The dogs behavior on the trail is relevant, which was to protect it's owner. Too bad the owner didn't tune into the responsibility of an owner which is to be the LEAD PACK DOG. That's right, as the owner you are the leader of the pack, dogs being pack animals. What, we have to explain this here?

Look, none of us wants to see a dog killed, or to have to kill one, but nor do we want to see dogs biting, mauling and harassing people. What happens to the mauled? They get a weak 'Sorry, man' and that's it until they get the lawyer involved.

Sure, on the trail I would like my dogs to roam. But did I forget something? Something important that involves considering others? I am not the only one on the trail! Photo-shmoto. Guilt tripping won't work.

248: How was the hunter supposed to know aggression from attacking. 202 had a point - do you have to let the dog bite you while you're lying on the ground before it's ok to shoot it? I'm an animal person - I volunteered at the shelter, and ADORE pit bulls and other large dogs. Yet I understand what happened (and I somehow don't think using a firearm as a club is a wise decision, despite what others have suggested). Both the hunter & the owner were saddened by the events that took place. I appreciate that they both seemed more reasonable than many of the commenters here. I'm one of the people who would have died to save my pet & defending the people recently who have lost their life protecting their dog. If the hunter was out of line then an arrest would have been made. Likely this is simply a situation where the dog owner could have exercised better judgement and the hunter likely did fear for his safety ( a 50lb dog is a "common weight" for european police dogs. a 50lb dog can still exert an incredible force )

Sadly the dog owner placed his pets in this position. Being a dog owner my heart goes out to you, but you should should have known better.

Noozhawk is reporting that a CHP officer is alleging that prescription medicine may be a factor in the accident. But that is not the point - The point is why it took responders so long to find any person this close to the road.

Shining a flashlight down there would have easily shown the car. All responders have flashlights and the FD crews have HID portable lights and installed on the truck.

How they are going to determine that it was prescription drugs with a blood test more than 15 hours later should be interesting.

Wow, some nonsensical posts here. An animal unsupervised on a trail is not a pet, it is not predictable, and it is not safe. If it acts in a threatening way it is a wild animal. Unless you were there you can't judge. If these weren't hunters with guns but instead a couple guys out for a hike, and they got bit by a dog the responses would be blasting irresponsible dog owners. But so many of you would rather ignore the fact (the absent owner) and make wild assumptions.

I feel very bad for the man that lost his dog, I have dogs and work hard to improve the lives of many other dogs. I am a "lib". And I reserve judgement on these hunters.

Vehicle Over Paradise Road

2013-01-22 03:24 PM

They finally got to him 15 HOURS later.

KEYT news states: "Santa Barbara County Sheriff's officials responded and searched areas off Paradise and San Marcos Roads for several hours, even using an infrared device"

Really? The car was just 20 feet off the road, and was visible from the side of the road. If any of the responders got out of their car and just looked, they would have seen him.

KEYT news: "deep in a nearly vertical embankment, roughly a half mile above San Antonio Creek Rd."

Really? That makes it sound like it was way down hill somewhere, deep down. And why do they use 1/2 a mile above a road as a descriptor, when it was about 20 feet off 154?

To make it seem like it was much farther from the road than it was in reality - to cover themselves for not finding this man?

If he had more serious injuries he could have easily died with that much time passing.

This is the problem when reporters use a press release when they write an article, changing few words of the agencies description of the event. It ends up being exactly how they want to present the event, rather than an unbiased and objective factual view of the event. Readers end up thinking "well they searched for hours and it was half a mile from the road deep in a ditch" rather than thinking that this man waited all night to be rescued and should have been found - and that maybe the supervisors called the search off way too early. And that perhaps they were distracted with the Loma Alta fire and didn't come back to look after the fire was out.

If I were that man, I would be grateful for being rescued this morning, but angry that it took them that long to find me and had to be out there all night cold, injured and trapped in the car.

Here is a picture of the accident site:

Time for a joke :) TOP TEN REASONS MEN PREFER GUNS OVER WOMEN:
#10 - You can trade an old 44 for a new 22.

#9 - You can keep one gun at home and have another for when you're on the road.

#8 - If you admire a friend's gun and tell him so, he will probably let you try it out a few times.

#7 - Your primary gun doesn't mind if you keep another gun for a backup.

#6 - Your gun will stay with you even if you run out of ammo.

#5 - A gun doesn't take up a lot of closet space.

#4 - Guns function normally every day of the month.

#3 - A gun doesn't ask, "Do these new grips make me look fat?"

#2 - A gun doesn't mind if you go to sleep after you use it.

And the Number One reason
Why Men Prefer Guns over women.. #1 - You can buy a silencer for a gun.

Dog owners when are you going to get it. Your animal is your responsibility and problem. Not mine and not the hunters. Yours. We, the rest of the world besides you, don't owe you anything in terms of not putting up a defense against an aggressive acting dog.

We don't have to wait and see what happens in a situation like this. Dogs can and do kill people. It's not my job to assess your dogs particular characteristics and behavioral modalities like some seer or dog psychologist.

My neighbors know it and now you do too- control your dog or someone else is going to do it for you. Period. No whining. If you can't handle being a dog owner with all that it entails, which is a lot, then get another animal or better yet nothing.

"When Bad Things Happen to Good People" by Harold Kushner is good for esp when you lose someone unexpectedly.

Also, I found this book to be very insightful and comforting: "Healing After Loss: Daily Meditations for Working Through Grief" by Martha Whitmore Hickman

A note about the Hospice of SB--this is a wonderful organization that offers free individual and group counseling. Your friend might want to check it out to see if she feels this is suitable for her.

Two hunters, returning from a day o...

2013-01-22 02:47 PM

183- usually pig hunters use rifles, not shotguns. That would be inhumane.

If the dog was acting like it was going to bite the hunter (who may have smelled like pig blood, depending on if the hunt was successful) then I think it was sad, but justified. Better to use pepper spray but if you don't have that, a gun serves that purpose too, in a pinch. I'm just glad the dog didn't suffer and they got a clean shot, rather than the dog owner getting sued by an injured bitten person. As someone maimed by a supposedly 'friendly' off leash dog for no reason, I side with the hunter, and wish I had had a big stick, knife, pepper spray, or gun to defend myself at the time. If you can't keep your dogs in sight and under control, don't let them run off leash.

That said, I love dogs, and am sad to hear the outcome of this story. I hope both parties learned something from this.

Two hunters, returning from a day o...

2013-01-22 02:41 PM

Once again, the ignorant responses always disapppoint. A dog, is a very dangerous animal. It had a person on the ground and appearing to be ready to possibly inflict a mortal wound. Though very sad, the hunter appears to have quickly run out of non-lethal options. IF your young son or daughter was lying on their back on the ground and a vicious dog is about to rip them to shreds, there is not one of you that would not be willing to kill that dog to save your child. This is no different. It is a tragedy, but no one can logically argue that the man's life was worth less than the dog's in this instance. Since every mention was made to the hunters being there legally, and hunting legally, the discussion of illegal and irresponsbile hunters is a pretty pathetic one, so the libs can just wrap it up now. This is really a very one issue discussion.

If the RAW images were not processed they would appear very flat and no detail. All your DSLR cameras shoot RAW and lots of point and shoots also have the ability to shoot RAW.

Picture styles are only possible when shooting JPEG which does edit your photos in camera.

138P, very interesting story about that chicken.

094, it would be the responsibility of the dog owner to keep their dog contained, we agree. However, to *shoot* the dog, whose fault it is not, is fatally punishing the wrong party.

I cannot fathom killing what would most likely be a loved member of someone's family. But dealing appropriately with the dog's owner, I'd be 100% in favor of that.

Sad story, but some of you are so biased you couldn't possible judge this situation fairly. It does seem an unwarranted response on the face of it. However, I wasn't there. I will also say any dog that attacks another human, unprovoked in this situation, was dangerous and shouldn't have been allowed off leash. How aggressive does a dog need to be before defending yourself or another person? Do you need to have it bite you while you're on the ground?

All previous posts are mainly speculation - Which I suppose is fine. This actually includes some data.

The FD hasn't come out and said it was homeless caused at this point, as far as I know. But this is what they said on the scanner. They started talking to each other on cell instead of the scanner shortly after this went out.

Perhaps Officer Rivas can comment on this. According to the vehicle code it's ilegal for a motorist to follow traffic directions given by a civillian.

So if a pedestrian is waving a car on through an intersection and yeilding the right of way with the gesture, the gesture is actually directing traffic.

The rules of the road are there so we all know what to expect from one another. As a pedestrian, I no longer wave a motorist through my right-of-way. I just stick to my own business and proceed lawfully while watching carefullly for yahoos.

No question that not having that through road to the beach changed things. A lot. I love riding my bike along there, but I don't think Ty Warner provided the landscaping out of the goodness of his heart. And having to drive all the way around in a car is a total pain in the rump.

There used to be a heck of a lot less watering and maintenance going on, cliffside, as I recall. Now, you can go by there any day, everyday, during the week, and see the "gardeners" at work.

You can't see the ocean as well as you once could, either.

I have a friend who pitches fits every time we bike past Ty's place. She's right. He has installed a jungle, which requires gawd knows how much water. It looks green, but I wonder how much water is wasted there, each and every day.

Bobcat's Chicken Dinner

I used to think of chickens as obnoxious and without character until I met my nephew's pet. This chicken had appointed herself his guardian. When she saw him try to make a break for the stairs off the porch, she would stop her scratching from thirty feet away and shoo him back up the steps. He was the only one she allowed to pick her up and just carry her around in any position for hours. Anyone else that tried, she went for the eyes. There were predators in the area but the chickens were put back in the enclosure, which contained their coop, before dark. The entire covered enclosure was firmly attached to a foundation that prevented digging under the fence.

Pedestrian Sting

2013-01-22 11:59 AM

Despite 366089's info (are we sure that applies to crosswalks controlled by lights?) and Hoosier's fear of honking, while you are "allowed" to proceed once the pedestrian has passed the half-way point, for the safety of pedestrians, it's always a good idea to wait until they have crossed the entire street before proceeding. Sometimes seeing another car waiting at the crosswalk is what gives other cars the clue that there's a pedestrian crossing.

It only takes about 10 seconds for most people to cross a street, surely we can all wait a few extra seconds to help ensure pedestrians' safety.

Pedestrian Sting

2013-01-22 11:54 AM

I walk a lot in town, often with one of my kids. Quite frankly, people are now so spooked (about getting cited) that some will slam on their brakes when seeing a pedestrian near a corner. Personally, I often prefer to let cars pass by and then safely cross when none are in sight. Some drivers react with hostility when I try to wave them on politely: thanks, but no, thanks. Cars in other lanes, sometimes with blocked views and not stopping, are often serious hazards.
That being said, there are far too many distracted people driving out there and walking can be scary--far more, I assume if you're elderly, disabled etc. Major intersections, Carrillo and Chapala and De La Vina and Alamar, even with lights and crosswalks, are often dangerous to cross. Almost all the streets (Sola and Garden or Santa Barbara, e.g.) bordering Alameda Park/Alice Keck MG could use sting set-ups, IMO. Have been almost hit there numerous times and I consider myself to be a very aware and careful pedestrian.

Hit and Run Update

Remember to notice cars in driveways under car covers that weren't covered previously. My neighbor hit and ran on our street, 2am. Other neighbors came out the next day with all kinds of details "It was so loud I was just sure everyone heard it. the scrapping was so loud...he didn't travel far." Sure enough, less than 50 yards away, under a car cover.

First and foremost you need a strong, well built chicken coop. The birds must be brought in at night to roost and for protection against predation. You can't blame the wildlife that come calling for their supper if you leave food out at night. Aside from that you can learn all you need about raising chickens from the local feed store. Good luck.

Pedestrian Sting

2013-01-22 11:42 AM

From Sergeant Noel Rivas, Traffic/Motors Supervisor - Santa Barbara Police Department

The Vehicle Code states a vehicle must yield to a pedestrian in a crosswalk at all times, however most of the local courts have used the following "rule of thumb": If a pedestrian has to stop and/or break stride to avoid being struck by a vehicle, then the violator will usually be found guilty of the violation. If the pedestrian steps off the curb and the vehicle is “significantly” away, then the courts will most likely not find the violator guilty. If the pedestrian passes the vehicle which has yielded and the vehicle then proceeds through, the courts will most likely not find the violator guilty. One more thing, if a vehicle stops to allow a pedestrian to cross, then no matter what the circumstances are, all other vehicles must yield with that first vehicle or be subject to being cited for failing to yield with a vehicle who is yielding for a pedestrian.

There would not have been even a bike path, much less the lovely landscape to enjoy, had Ty Warner not stepped up to pay for both the bike lane and the landscape.

If the road was still there, you could expect all southbound traffic coming off Cabrillo Blvd to clog the road rather than drive through CVR to the 101 S on-ramp.

The bike path turned out to be a very nice solution.

Here is the answer to the inevitable question that's asked whenever this type of thread appears...

If you are stopped on Milpas for a pedestrian that is crossing the street from your right to your left, you ARE ALLOWED to proceed once the pedestrian has passed the halfway point. You DO NOT have to wait until the pedestrian is standing on the other curb.

BTW the heaviest fine you can receive in one of these stings is for proceeding through a crosswalk when a car going in your direction is already stopped for a pedestrian.

From past experience, cigarettes get blamed for a lot more fires than they deserve. Case in point...You seldom see roadside fires caused by cigarettes and when you do it is in Paso Robles or some other much drier clime. Cigarettes usually need "packed" materials (like a couch) much like the cigarette itself to cause a fire.

My guess is "human caused." And transient would probably be a second good guess.

Could be from an auto or other source as well, but probably NOT cigarettes...

046: Why run if it wasn't your fault? And hit & run is still hit & run, regardless of whether the person you hit wasn't where they were supposed to be. Little kid runs out in front of my car & I kill them & drive off, I'm pretty sure I'm a horrid human being & in quite a bit of trouble. But maybe this situation is ok because it's an adult.
Remember when the drunk people were crossing near Earl Warren & got hit, then the driver took off & was captured later? Yeah, he got in trouble for that even though the pedestrians were drunk & in the middle of a not well-lit road, away from the crosswalk. (Admittedly, he was house arrest/probation/something, but still. He got in trouble because IT WAS WRONG.)

The woman was not wearing a track suit. She was wearing a red sweatshirt with lots of stuff in the front pocket and a skirt. She was in her 20s, white, medium height, sandy brown hair. She was talking to herself/people who weren't there, like she was psychotic or on drugs. Her face was red, like she'd spent the day in the sun. After we tried to stomp out the fire ourselves, I went after her, but no luck. I asked others on the trail if they had seen her. One man told me he saw here wonder toward the golf course, the one near Devereaux.

I was surprised that the others at the scene were not motivated to stop her from leaving the scene.

By far rhe worst offenders to the rest of our well being are:

-cars that blow though pedestrian cross walks.
-distracted pedestrians (texting) walking into traffic.
-cyclists that blow through stop signs, ride on the sidewalks.

If we could get drivers paying better attention to pedestrians that would be good Seems there was a ped vs vehicle almost every week for months now.

With lawsuit pending, controversial...

2013-01-22 10:01 AM

I think the parking thing is key. If there were 12 residential units (e.g. condos), Pini would be required to provide parking for 12 cars, too. With only 2 residential units, I believe he is only required to provide parking for 2 or 4 cars--even though the total number of bedrooms on the lot would now be 9, and since it's a Pini property the number of adult residents would likely be nearly twice that. That's a lot of congestion. As for the architect, cry me a river. There's good design, and there's bad design, and there are ways of building out a lot that have fewer or greater impacts on the neighbors. There are lots of details not addressed by zoning, and everyone has an obligation to be a good neighbor.

Appropriate to the district. Hmph. First of all, the district is an inhabited place, not a static image. Accommodating people, and kids, is okay. Secondly, nothing about Paseo Nuevo looks like authentic California Spanish or Spanish Colonial Revival. There's a Spanish "style," but it's been modernized and greatly expanded in scale. The best big Spanish Colonial Revival in SB is the county courthouse, and it's quite a different scale from Paseo Nuevo. Most of the fountains of the old days were really basins of aqueducts set up to provide water, so they were low and accessible by bucket. We see such fountains, now purely decorative, all over town. Perhaps among the grandiose Spanish Colonial architecture of Mexico City or Lima, this columnar "fountain" structure would be more appropriate.

It sounds like it's being over run a bit overnight sleepers, intimadators..I just heard this morning where a business entryway was blocked in the 200 Block of Palm Ave.

@ coyote... Great Thanks! I actually do have some apache in me but its pretty much impossible to prove. It's very unfortunate for people like me who do have some Native American in them but have no way of proving it (documents) and are thus left out from cultural ceremonies. I'm not looking for $ just a chance to learn more about my heritage.

Bobcat's Chicken Dinner

2013-01-22 09:25 AM

I'm with all the others who said it's the responsibility of the owner of the chickens to make sure they're secured and safe.

We humans have encroached terribly on the environment of our wildlife, and are continuing to do that. Do your homework before you move to an area with predatory wildlife. If you have animals - or even children - who might become prey to them, don't move there. Or take other precautions, but be well aware of the risk involved.

Interesting to see the fire engine on what looks like the closed (except to bicycles) part of Channel Drive. That road should never have been closed, but should have had land taken from the property to the north when the cliff was eroding.

Hit and Run Update

2013-01-22 09:15 AM

Get away with what? It's hardly a punishable offense when you hit someone walking in freeway lanes, where a person isn't supposed to be. For there to be a crime, it presupposes the victim was in the right. The only crime committed was fleeing the scene of an accident, which will more than likely be dropped.

Moon & Jupiter

2013-01-22 09:13 AM

Because, RD, it is.

Jupiter is 11 times as large as our earth, and the earth is 3x the size of its moon. But as people thought the sun rose and set while we were stationary, so the appearance of Jupiter, a bright dot next to the moon does not show its true size. Seeing may be believing but it's not necessarily truth as inaccurate eye witness testimony often reveals. :)

New Paseo Nuevo Fountain

2013-01-22 09:03 AM

Gentlepeople,

There are always those who blame "the government" for everything, usually without a clear understanding of what our government actually does, or how.

The City Council does not approve architectural design; the Historic Landmarks Commission (HLC) and Architectural Board of Review (ABR) have this responsibility. Within El Pueblo Viejo (Paseo Nuevo's location) HLC has jurisdiction. Their job is NOT to dictate design, but to guide designers within the context of our Spanish Colonial Revival-based downtown. This new design is in fact more appropriate to the district than the original.

That said, the original design was more attractive and engaging, to kids and probably everyone else. The only element of the new design that might be considered an improvement is the more comfortable and user-friendly continuous bench that replaced the steps. The steps were more versatile, but not comfortable for seating for long periods, and not easy for elderly or handicapped people to use.

It MAY be that the original design was too much of an attractive nuisance (lawyers & insurance companies silently rule our lives). The twin fountains at the State Street entrance were (sadly) removed some time ago, possibly for the same reason, as well as to save money on maintenance and upkeep.

AGAIN, another vagrant related fire. They (vagrants) impact everyone in the City. Whether getting off the freeway and seeing the "camps" with the associated beggars on the off-ramps, to aggressive panhandlers getting in the faces of tourists and locals alike, loitering, public urination, the list goes on... My last post on this subject was removed, as it is politically uncorrect. Is it uncorrect to mention the HUGE cost of the "Homeless Industry" in SB as well? The thousands of county, city, housing authority employees who need the "homeless" to be here so they don't have to work in say, Fresno. There are cheaper places where these "homeless" can rent a room for a couple hundred bucks a month-but the homeless industry won't talk about it as it's OUR problem, here in SB... I call BS.

Seems like parking is a major issue here; street parking is unacceptable. In Carpinteria we have to provide our own parking, with a garage; carports are no longer acceptable because garages were being rented out for living in and ugly, flimsy carports put up. Unrelated people renting is not such a problem, their cars are. Off street parking should be demanded for any residental or business development.
