Motion to Dismiss Chumash Lawsuit

From an LA Times book review...the gold rush was far worse than the Missions for the native Californians. Bet you didn't learn that in school. It is said 300K or far more natives lived in CA before Europeans came.

"By 1860, the aboriginal population of the state dropped from 150,000 to a mere 30,000; by 1900, it was down to 15,000.

During the second half of the 19th Century, the new state of California established what amounted to the legalized slavery of the native people, and subsidized scores of military campaigns which carried out "the brutal murder of thousands of California Indians."

White settlers and soldiers systematically exterminated entire native villages, and strung up Indian scalps for display. ....Considering the additional effects of social disruption and disease, it is not surprising that some recent historians have spoken of "genocide" in California."

Pasta Shoppe Closing?

2015-07-05 07:21 PM

I have lived here for 60 years and am fairly savvy about what will work where and what won't. The big time developers and promoters and those who's vision of Santa Barbara came from a soap opera and slick magazines, don't bother to talk to those of us who have seen dozens of restaurants and other projects come and go. Que sera, sera! When I heard the "Public Market" idea early on I knew it wouldn't work and I have not and will not bother to go there to prove I was right. One of the things that are still "small town" about Santa Barbara is that word travels fast. Just look at the fiasco of Haggins grocery markets who bought out Von's and apparently figured everyone here was stupid, rich and lazy so they could just buy in, do nothing and jack up all the prices by 10 to 15 percent and nothing could go wrong!

"Steve Pappas fan club" no, people are growing tired of the developers of massive out of scale developments that have no public input, by the corporation known as the "Chumash". This Chumash corporation is not required to follow zoning or development regulations and they build whatever they desire in our county and pay no local taxes for that right. We are all held hostage to the whims of the Chumash, and many of us are tired of this out of control Corporation that has been granted special privileges by the federal government.

I sit with my dog laying down next to me while I watch the events on tv to mask the outdoor noises as tv noises. I pour lavender & chamomile essential oil on my hands and massage lavender oil all over the pads and body and a little on the face, not near eyes. This deep massage method always calms him down and he loves the attention and sometimes he even likes watching the tv too, very interesting. I've also put chamomile tea and honey in milk in their evening meal, laps it up.

What do Rattlers feast on , July 4t...

2015-07-05 01:22 PM

648 : We were no more than 3 feet (2 stair steps) from the Rattler.
He never showed any sign of agressivity .
Like most wild animals : rattlers will leave you alone if you leave them alone. They defend themselves if they feel threatened or you attack them.
They focus their attention (as well as "venom reserve") for prey which they can then eat.
I'm pretty sure that he felt he could eat the lizard but not us. He most likely knows that we were (way more) than he could "chew on" .
Rattlers have a "bad" reputation (they are not the most "cute" of wild animals) but they are not the threat commonly thought to be.

Needless to say we left him alone after his meal and he was gone within minutes ..
We respect wild life too much to think otherwise.

Calming Pets During Fireworks

2015-07-05 01:08 PM

To flicka:     Tradition has it's place. Tradition is a metaphoric celebration  that  connects us, in a positive way, to our past success, our joyful beginnings.    But tradition has to meet the test of time. It must continue to  connect past and present in a positive way,  and cannot challenge or harm present day culture.
When tradition clashes with the society it represents, and
remains stubbornly repetitive, regardless of negative consequences, tradition becomes an odd, outdated   ritual...  A mass ritual that takes  on a powerful dynamic of it's own,
separate from it's  originally benign  intent or purpose.   Any  ritual that fails to meet  the test of time cannot be defended under the name of  tradition.

Rattlers sometimes anesthetize their prey before consuming by inducing respiratory paralysis via fangs filled with venom. You captured nature in action. Nice job documenting, wasn't aware lizards are on a rattler's diet. Rattlesnakes may only need to feed once every two or three weeks. Disturbing a rattler when it's hunting might cause it to strike you. Usually you hear the rattles first if you are trail hiking.

633 - evil knows no boundaries. Evil things have been done in the name of religion, and in the name of non-religion, and all sorts of other "isms".

There is also a trend that is noticeable in a large number of countries, regardless of whether they are communist, free market, authoritarian, muslim, religious, non-religious (North Korea), Banana Republic, etc. Wealth tends to concentrate at the top, and in the hands of few people.

However, evil in the name of religion is the worst, because religion is not supposed to result in that.

Kelp Washed Ashore in Goleta Bay

2015-07-05 12:01 PM

"You admit to trying to build a flock at Sands, where none existed" Nope, I did not. I personally have never had anything to do with COP but visit a few times a year. Nobody builds a flock, but the birds. I thought I made that clear. There are Snowy Plovers trying to breed on East Beach, but they will probably never be able to build a flock there, because of people and beach cleaning. Most people don't know that, because pairs of birds are harder to see than flocks. I think that there have been some birds that nested on the Devereux mud flats as well, but I am not sure.

What you are looking at, from your own experience, is a truncated history of Snowy Plovers, and you are extrapolating that small window to assert a claim that you cannot prove. In addition to the fact that you may have missed non-flocked pairs of birds breeding where you could not see them.

Animals choose, where possible, even among all the urban garbage, to find suitable places to reproduce - that is their primary instinct. If they find a place, they stay for at least one season.

"There are over 100 biologists making fiefdoms on VAFB as we speak". So I guess they hire and pay themselves? Making fiefdoms? Your glasses are permanently tinted according to your prejudices. I can guarantee that there are not 100 biologists all studying Snowy Plovers. VAFB is vast with many natural, unspoiled areas, and the research certainly covers a wide variety of life forms. For which life forms, many people have little respect, and are only concerned with me, me, me.

After doing a bit of research on Frank G.Nicely, I discovered that he was born in 1888, and was originally from Ventura County. The 1915 SB City Directory shows him as living at the American Film Manufacturing Company, 101 West Mission Street. He is listed as being a Property Manager. He shows up in other Ventura Co. directories before and after 1915 working as a farmer or laborer. However, by at least the 1930s, he lived on his own ranch in Santa Paula with his wife, Constance, until at least the early 1960s. Frank Gardner Nicely died in Laguna Hill in 1980.

Since the article here uses "never churched" and "dechurched" but doesn't define "dechurched," here is the definition from the source:

"Barna tracks not only overall churchlessness, but also what proportion of unchurched adults are “dechurched”—that is, who used to attend regularly but have not attended at all in the past six months— and what proportion are “never churched”— meaning they have never in their lives regularly attended a church. Among the general U.S. population, 29% are considered dechurched and 9% are never churched, for a combined total of 38% unchurched."

West Palm Beach/Ft. Pierce and SB/SM/SLO regions are 1 and 2 in "never churched" while SF and other large West/East coast cities are first in "dechurched."

Paid shills in D.C. raking 10% off the top of a money dumping scam. Poverty stricken walk into a casino and give over their paychecks attempting to hit the big time. They don't, it's statistically improbable and the machines are rigged on any given day to pay out ZERO.

This has nothing to do with Indians. Nothing to do with "land taken". Nothing to do with hope and dreams and agriculture or peoples of native dissent.

It has everything to do with a land and money grab by the corportocracy.

The whole plover debacle started at Surf beach.
There are over 100 biologists making fiefdoms on VAFB as we speak. There were only four just a few years ago. Same Brilliant biologists went to Surf and did a "fish count".
I was there.Only 2 people were fishing that day and they had around 6 fish. Biologist says that's not enough of a catch, so must be something wrong. Week before we had caught (and released ) over 20 lunker surfperch. Now we cant fish anytime of year because of flawed research. I'm not just barking from my chair, I LIVE this life and am out there observing it for the last 54 years.not just a day at a time.
USFW admitted there was no OFFICIAL count of the bird until 1996.Don't know where you were.
You admit to trying to build a flock at Sands, where none existed.
Maybe you should go to Canada and see if you can get the Geese there to stay when the weather changes instead of MIGRATING following the food source.
Good luck with that.

interesting comments....I grew up going to services until I was 16...then went to England to school and started attending services at lots of different churches--and finally came to the conclusion that I didn't need the intercession of organized religion with "the higher power". I agree with the comments about the strife and violence promulgated by organized religion. But we need to find a way of being in touch with a higher plane of being--of being human--if we are to survive on this over-crowded planet.......

That people are de-churching or never churched signifies old systems of dualistic control are fading; the new 'religion' is the state, one world government, and worship of the earth or physical plane. In either case, it's about removing your connection to the other unseen world to control & rob your power.

The body is the temple, if you want to find 'god' or the supreme being look within. The system of slavery that has been dominate on this planet for thousands of years is in it's death throws, and the controllers know it, that's why we're being attacked in every way imaginable.

There is no end only forever so why not enjoy the ride?

Yes, and identify the white and hispanic people whose DNA is evidence of their forced marriage/rape of Chumash widows after their Chumash husbands were killed for bounties offered in the 1850's by Santa Barbara County.

``They can build the tallest building in the area by a lot even though NOBODY who lives in the area wants it!''

@479 I've seen Kumare and thought is was a very interesting documentary. But it doesn't validate "western" religions. It shows how people are thirsty for spirituality, and it shows the power of the mind when we want to believe something. It also shows that there are those willing to deceive these vulnerable people. And anyone would be crazy if they said that western religions don't take advantage of this vulnerability at times. There is a lot of brilliance in some of the eastern spirituality teachings and healing methods. For anyone to reject that is foolhardy. I read your post as WESTERN = GOOD, EASTERN = BAD. How bizarre, misguided and close-minded. Good, sound spiritual thinking can come from anywhere on the planet. Being religious does not always equate to being spiritual.

Kelp Washed Ashore in Goleta Bay

2015-07-05 07:43 AM

"Historical records indicate that nesting western snowy plovers were once more widely distributed and abundant in coastal Washington, Oregon, and California than they are currently.

In California, there has been a significant decline in breeding locations, especially in southern California. The first reliable information on the abundance of snowy plovers along the California coast came from surveys conducted during the 1977 to 1980 breeding seasons by Point Reyes Bird Observatory (PRBO). The surveys suggested that the snowy plover had disappeared from significant parts of its coastal California breeding range by 1980.

Subsequent coast-wide surveys by PRBO in 1989 and 1991 indicated a further decline in numbers of breeding adult snowy plovers on the coast. Coast-wide survey during the summer of 1995 suggested about a 20 percent decline in numbers of breeders along the coast since the initial 1977 to 1980 surveys.

Once numbering in the thousands, fewer than 1,500 breeding plovers are thought to nest along the California coast. Prior to 1970 the coastal population was thought to have nested in over 50 locations in California. Today, snowy plovers nest in only about half as many locations."

http://www.westernsnowyplover.org/pdfs/plover_natural_hist
ory.pdf

The reason for their decline is that humans have basically kicked them out or made the locations so unsuitable that they have not returned. Make the places suitable again, and they will come (back). So much for the nonsense, unscientific, factless, data-lacking, out-of-thin-air, misinformed comment "Let me state that there never was a population of plovers there."

People haven't lost their religion; religion has lost them. We work parttime in a state where before defaulting on a handshake promise or contract, they "pray on it" and use that as the justification for not doing what they said they would do. After years of persecuting others they now worry about their religious "liberties' to discriminate and harass being taken away. Don't miss that and enjoying living and working in secular SB.

"Let me state that there never was a population of plovers there." Well, what are they doing there now? Were they enticed with tasty morsels of food, and then when they got there, chained to the beach?

"Biologists of all sorts, and the U.S. Fish and Wildlife Service have made thousands of full time jobs on the backs of the taxpayer" Thousands of full-time jobs for the Snowy Plover? That is a blatant falsehood. I doubt if one job was created just for the Snowy Plover. The crew that looks after the Plovers are all volunteers.

"then deny access to same taxpayers" I have been to Sands may times, and have never been denied access. In fact, Sands is a good example of people and wildlife sharing the same beach.

Some people, do not care where they live or how many Chinese imports that they have accumulated in their homes, but find research, increasing one's knowledge about the natural world far more rewarding than the life you obviously, blindly live.

"WHY does the coastal band of Chumash who are NOT recognized"

The reason why the lawsuit was thrown out is because the Chumash ARE recognized. In fact, the Santa Ynez band is the only federally recognized band of the Chumash.

What is striking about the pro and con arguments, is that all of the con arguments are false, are not cognizant of the history and laws governing Reservations, and hence can never be taken seriously. They are also the most emotional and nasty.

Vincent Armemta's mother is German. His father is Hispanic!

1. now that DNA is affordable how about the tribal leaders share the truth? At what percentage do native SY Band of Chumash Indians actually have Chumash blood Pumping thru their veins?

2. To date each tribal leader receives $50k a month tax free!

3. Each tribal leader owns substantial land locally outside the upper and lower Chumash Rez. Many own property in Lake Tahoe.

4. WHY does the coastal band of Chumash who are NOT recognized NOT receive ANY financial benefits? If the Upper and lower Rez is so saturated with Chumash elders, etc. what will be the fate Of the down trodden once camp 4 is developed for their greedy housing needs?

5. Has anyone ever wondered WHY our coastal waters is prime for panga boats bringing in cartel? WHY are all the Chumash busses tinted with ZERO visibility from the exterior? Including the drivers windows?

6. Last month 3 lives were lost at a ghetto hotel due to Herion overdoses. This hotel sits next to the Chumash busses fueling station across from the upper Rez. How about turning this dive into a brothel and a pawn shop?

7. Regarding Mr. Armenta, our Valley finds it ironic that a man who claims to be part of a culture whose ideology is founded on the principle of preserving the land is so dead set on defiling it. As is the current vogue mr. Armenta likes to wave the racist card when it suits him! Our Native American should be reimbursed for their disgraceful treatment at the hands of history, but at what price and for how long?

8. Many in our valley fear a recent Mexican cartel drug bust on Happy Canyon which received VERY little media ink!

If our people loose our open land to do greed we shall all feel the tears of the American bald Eagle as they circle what was once green and promised land........ [ more ]
