Man Sues City for Falling Off Bike

2014-09-17 10:30 PM

SHARE, I doubt it--I only brought up the possibility because I was pretty appalled at the viciousness of so many comments, based entirely on the commenters' biases and imaginations....I believe in freedom of speech, but I think that there is a line between speaking your opinion and making personal comments and judgements. There ARE other websites that have places for that; I don't think this needs to be a place for people to vent their anger and negativity in a personal way. There is also a big difference between a thoughtless remark or response, or a perhaps misguided attempt to be funny, and getting personal. As far as legality? I suppose one could subpoena the real name and address of a commenter. Would Edhat have any liability? No idea! maybe the Nanny knows..... ;)

Blue Shield Supported Alternative L...

2014-09-17 10:14 PM

To the OP-If they take the CC Blue Shield, I'd recommend Island Gastroenterology in Ventura. Drs. Menz, Covington, and Lin are all very good, and I would expect the other partners to be just as good. To 396. a late response-- TriCare and ChampVA pay exactly the same amount as Medicare. There aren't any strings attached, though, like high volume or other Federal funding, so our well-off local facilities feel free to ignore them. My comment was oriented more towards their lack of patrotic and community sense of responsibility. And yes, Blue Shield does bear some responsibility for not getting local providers. I'm just curious as to why coverage isn't a problem In SLO and Ventura Counties? I am guessing that Cottage and Sansum checked the numbers and realized that the number of people signing up for Covered California Blue Shield wasn't high enough to give them any political or financial clout, and the reimbursements weren't what they wanted, so they refused the contract. After all, they both have lots of extra money....even if it isn't earmarked for patient care.
662, I agree, but I've had the same experience finding coverage with employer plans in the past. I have to say, covering my daughter on private employer insurance was $1350/ month (2 people). Adding her was approximately $1000/month. With Covered California's best PPO plan her insurance is $367/month. Still have to pay the 20% not covered by insurance, but we had to do that with the employer insurance too. It's still a BIG savings! That said, we will be switching her to CC Blue Cross next year because of the contract issues. It would be SO much simpler to just have everyone covered by the government and MD salaries set, the way it's done in Europe. They think our system is barbaric, and it is. At least this year it's a little bit better than it was, though.

Also Montana. I was just visiting a family member there and they were not happy with dears or bears at all. I was on the other hand, got so excited every time I saw one I just could not believe how many there were. To the montanans, they were a big nuisance. My excitement was not shared at all by them. They really do cause major accidents that end-up totaling cars and killing people. So no wonder.

Man Sues City for Falling Off Bike

2014-09-17 08:22 PM

455 - I agree. The city prevents homeowners from even pruning the roots without a permit. My neighbor contacted me about a tree on my property which had roots which were uplifting her driveway as well as destroying the sidewalk on my property and the city sidewalk in front of my house.

I'd be more than willing to remove the tree and have something more suitable put in or have the roots pruned.

I contact the city just to double check. They quickly checked and confirmed they were their trees. They told me I could not prune the roots or replace the trees without their permission since they planted them. This is in a place where there is no green space between the sidewalk and the street. The trees are actually in my yard.

I asked at the time if I was liable if anyone hurt themselves because of the uneven pavement or for damage to my neighbors property. They assured me that I wasn't and that it was their responsibility.

I asked them to come out and take a look, they did and merely put unsightly asphalt ramps everywhere and left.

If they know there is a problem and they choose not to do anything about, then I think they should be liable for any injuries or damage just as we would be as homeowners.

How is it that so many people can be so vicious based on so little information? SB used to be a lot more tolerant. There are laws about making frivolous and/or inappropriate lawsuits. The judge obviously decided that this one is OK to procede. Will he win? We have no idea, not having heard all the facts. He could lose. Our legal system is based on having juries decide. If I were this young man, though, I might start thinking about online slander and cyber-bullying based on some of the comments I read here. Thanks to LokelYokel for the chuckle, though!

That's probably what he told his wife they were too, friends. You're right, it is a whole other story. I have no idea who this man was and why his head was hit by a train because he supposedly walking to close...just sounds too odd. People are so quick to blame everything on drugs and alcohol. Alcohol and drugs are used as an excuse to excuse so many deaths in the world and as reason to not further investigate. People who die tragically or painfully have alcohol in their blood even when they haven't been drinking because their pancreas releases alcohols, and with inept coroners they'll say the person's been drinking when they haven't.

Thank you 553424 and 553319 for providing useful information.

Like many, I am an individual and so can't get insured in any other way than CoveredCA. Access to information was so awful, that I applied for a plan based on false information about providers (from Blue Shield) that accepted the insurance. At the time I applied, Sansum was not participating with CoveredCA. That changed, but there was no way for me to find that out. If it had said on the application, "This plan covers preventive colonoscopy, but you'll have to drive 40-100 miles to get it, and the places we tell you provide it will hang up on you, leave you on hold, or tell you kindly that they don't accept Blue Shield/Covered CA. So get creative!" -- Well, I wouldn't have picked that plan.

567: I hope your ok. Maybe you ought to see a physician. That type of fall can do two things. 1) cause a strong desire to shake it off as no big deal, It's embarrassing, it doesn't matter, etc. 2) The fall could have caused physical damage that you're not aware of at this point in time and needs treatment right now. Except the nature of the trauma causes it to feel like you just want to ignore the whole thing. Your age plays a significant factor in this too. So if you're very young it's probably not as serious as it could be. However if you're older, then it really can be serious. Hence my concern

I'm conflicted on the surface there are elements that do sound a bit like a scam. However, A judge with all the evidence at his fingertips, came to the conclusion that the musician had a valid case of negligence against the city. After all, is it not one of their biggest responsibilities, to make sure our streets are safe, Right? On the other hand why would anyone choose to ride down a street that is in such bad condition? I guess he could've chosen to get off his bike and walk, then let the city know of the danger. This is discombobulating!

Additionally, if you had thoroughly read the posts you commented on, you might of been able to assure yourself that neither one of The comments stated that bicyclists are suicidal. Both comments suggested and wondered why some people who ride bikes are reckless. Pointing out the danger they seem to be oblivious to and choose to engage in. I actually feel concerned for their safety and want them to make it home without being hurt. That I can assure you is true. For the simple reason that this is my truth and reality that I experience. You however can make up your own mind. I'm sure you will. based on your comment that strikes me as the kind of person you are, it's definitely not the truth about who I am.

Students Allege Mishandling Sexual ...

2014-09-17 05:02 PM

All witnesses (including the accuser) may be cross-examined in the UCSB process. It is straightforward to google the UCSB Student Conduct rules and correct the numerous errors in 081P's post.

All educational institutions have the right to demand behavior that is better than what the mere law requires. In fact when students enroll the explicitly agree to follow the additional requirements of universities and colleges.

It is because imprisonment (and other taking of property etc) is a legal consequence that all the bells and whistles of due process are necessary in a legal action.

University actions are never a substitute for the legal process. But Universities do have every right do demand even better behavior than the law and expel, suspend, or sanction students who don't live up to their agreements.

Bear Killed in Traffic Accident

2014-09-17 03:17 PM

That makes it 3 bears this year, there were two killed on the 154, one by the family on the way to the Casino.

The general feeling in our planning is - we're okay with wildlife as long as they don't get in our way or slow us down in our headlong rush to live our lives to the fullest.

Is there anyone else beside me that thinks we should take the grizzly bear off our state flag because we will never allow those apex predators to reside in our state except in a zoo?

Bear Killed in Traffic Accident

2014-09-17 02:57 PM

Share, Oaktree, I can assure you cyclists are not suicidal any more than any other person. They want to arrive home safe to their families just like any other person.

I can't tell you why they would ride in a group on 154. I have ridden 154 in a very small single-file group, but I no longer would do so. When I did so, it was 20+ yrs ago in the middle of a weekday. Traffic was very light to nonexistent.

Nobody is riding a bike because they want to harm themselves or others. They are not oblivious to it either. They expect to be treated like another road user per the law, AND they should act accordingly by following the laws themselves.

p.s. to the original story, nobody said the driver was speeding, sometimes accidents happen to good people and animals.

Checkpoints don't instill any negative feelings in me. I drive up, hand them my license, tell them I'm sober, and drive on.

If you are law abiding, why would they?

You also skipped the part about "checkpoints tend to reduce the number of impaired drivers on the road". So there weren't more arrests, perhaps it just means people got safe rides home instead?

If it saves one life. . .

It needs to be a little simpler regarding the waste disposal of aerosols, paint, fluorescent bulbs, computers and electronics. As it is now I have to wait for a hazardous waste day and haul it all over there or go to UCSB to get rid of one shop fluorescent bulb. Hassle.

The psychological influence of checkpoints is to instill fear and loathing into the normal lives of law abiding citizens and to reduce the trust level between police and citizens, which is already at this point non-existent. As stated in the article the checkpoints do not result in any significant increase in DUI arrests.

Checkpoints are also political cover for a police force and City Council afraid of confronting bar owners and the alcohol lobby. Checkpoints would not be necessary if cops sat outside bars. That could have a psychological influence on bar owners and patrons, where the large majority of drunk driving originates, at the bar.

Navigating on a street or sidewalk, you take what you get in front of you. If it's uneven you're supposed to notice that and go around or whatever. No City in the world has perfect streets and sidewalks, if they have them at all. Was the guy on his phone? Drunk?

Not enough info but I think in general we must be responsible for our own travels along byways and highways, not blaming someone else. Attention Defecit is a national epidemic now, due to iPhones and computers hyping us all into warp drive, but we're still biologically wired for horse and buggy.

I'd just like to take this opportunity to promote the upcoming community Jesusita trail project that is going on in 2 weeks on the 27th. Instead of complaining, arguing and name calling, I suggest coming out, hiking the trial, and get your hands dirty making the SB front country a beautiful place to enjoy.

@489P- they had a bunch of fans at Kmart this past weekend so try there. They are all geared up for the returning college students so no Xmas, just summer stuff.

Back in the 80s & early 90s I worked for the large department stores (the Broadway & Robinsons) as a visual merchandiser. We started behind the scenes with Xmas in July and we put small "shops" in the departments with Xmas merchandise in August. Some people loved it but I got my fare share of chewing out by customers. I always directed them to the store manager. That was above my pay grade! Just remember, the people setting up the Xmas stuff are just as annoyed they have to do it as you are seeing it. Personally, I hate Xmas now because I had to deal with it for 6 months of the year for too many years.

2. This claim for damages isn't that egregious. When I worked for Risk Management at the city back in the 90's my favorite claim was from a woman who was thrown (yes, thrown) out of the Chase Restaurant on Coast Village Road and said the city was liable because we didn't have some sort of protective fencing for individuals who were forcibly ejected from bars for public drunkenness.

Questions About Ringworm

I've found that a solution of a high concentration of epsom salt and water continuously applied to the area of the ring worm dries them out within a couple or few days. It works really well on people, on animals they may lick it off which could be bad depending on the situations with your animals. Epsom salt mixes work well with lot's of topical situations, including some internal situations as well.

Man Sues City for Falling Off Bike

If you live in a cold climate where frost heaves move sidewalks and pavements or large trees cause buckling, you get used to watching where you are going. There is absolutely no expectation that the outdoors can be even, smooth and safe like an indoor surface. What is the cost to taxpayers of trying to meet that (unreasonable) expectation?

Questions About Ringworm

2014-09-17 11:33 AM

Funny, I had not thought about ringworm in years. When I was in elementary school in Kansas, a rather large percentage of the kids had it. We did not know what it was at the time, but they had to shave their heads. I did note that many of those afflicted were farm children, while the city kids did not have the same problems. Times have changed since then, each fall at least one or two of our classmates did not return. They had died from something, and it was never, ever discussed. We just accepted it.

Man Sues City for Falling Off Bike

2014-09-17 11:20 AM

I walk to and from work, as well as during lunch every work day. I fell last week on the sidewalk during my lunch walk. I cut and bruised my knee, cut my hand, broke my bracelet and my phone. (No, I was not texting.) The tip of my shoe caught on a rise in the sidewalk, and I simply fell. Hard. I had to call my office to pick me up, as I was shaken and couldn't walk back to work.

It's unfortunate, but it happens. I do feel that it is the City's duty to maintain the sidewalks and streets in a manner that accidents such as this are more avoidable. Everyone has a duty to one's self, but the sidewalks are a mess downtown.

Yes. I found the irony too. Also, the inflexibility of "corporate" entities. My bedroom fan died a few days ago. Went to Costco...all fans gone, but hey! I can buy snowmen and Santa Clauses. Went to Home Depot and Osh....nope. They were already into Fall and Winter....finally, went to Home Improvement Center (they are an individually owned franchise). the only ones in town with fans....and, they made out like bandits! Good for them for being able to be flexible and on top of an immediate need. Everyone had fans in their shopping baskets. Costco, Home Depot, OSH, lost thousands of dollars. Very happy to see a local company figure things out and supply their local community with an immediate need.

The system that we had was only working for the lucky ones that had health care. The system that we are moving to will provide basic benefits for more people but they will have to train more medical professionals to handle the increased workload.

It is difficult to develop a good system when 1/2 the politicians think that poor people don't deserve any health care. That same group wasted more than 1 trillion in Iraq and Afghanistan.

Someday soon we will have to choose between bombs or colonoscopies. We are not able to spend for both- the deficit is proof of that.

The street in front of my house is buckling and there is a lip between the street and the concrete gutter. It caught the wheel of my bike and I feel off. If I had sustained serious injuries due to this, should I sue the City for not maintaining the roadway? I pay my property taxes, so do I have the expectation the City will maintain their infrastructure properly?

By the way, a couple of years ago the City's contractor came through and replaced the sidewalk next to trees where the roots were causing it to uplift. Not the sidewalks are uplifted again. If someone trips and fall, who is to blame?

For sure, its legitimate to sue the city if you get injured by, say, falling in an unmarked hole in the side at night, or getting hit by piece of shedding palm tree. But this case *appears on the surface* to be stretching things. What time was the plaintiff riding his bike - and of it was during the night, did he have a bike headlamp? (Most cyclists in this area ride at night without front or rear lights).

Another view - he probably sustained a massive hospital bill for treatment, even with insurance - so perhaps the easiest way of paying off those humungously inflated fees is by engaging the legal profession in the hope you might win some damages. The lawyers certainly ain't going to complain.... and it might save one from losing one's house and ending up homeless on the street.

And we know what people think about the homeless around here....

$2.8 Million Environmental Violatio...

It is disappointing to see people respond to this news as earlier posters have. It is the responsibility of economic actors to comply with environmental regulations for the benefit of all people and our planet. Prices necessarily must account for expenses associated with environmental compliance. Any retail price set without accounting for such expenses is artificially low. Search online for "North Pacific Gyre." Look at the pictures. Think about what it says about us as a specie. Maybe people who play a role in checking practices that contribute to environmental degradation deserve credit, not blame.

$6,000 cost sharing to medical providers? I don't know any Medical provider that received $6,000. The cost is shoveled onto the patient.
Obamacare isn't care. There isn't any "care-ing" in Obamacare.

For those who voted for it, it's not working. The premiums sky-rocketed. The deductibles are high. The patients are paying out of their pockets for care that used to be covered by their insurance. Most patients won't meet their deductible in this calendar year but thank goodness that Fluk gal has birth control.

It's not an ego thing. I'm telling you. Obamacare isn't doing what you were promised. It's really ok to admit that you were duped. The sooner you do, the sooner we can move on and get a real health plan in place.

The street tree gestapos won't let homeowners remove these trees that are obviously unsuitable for the location trees and reduce liability by replacing them with more suitable species. For me, I give them the benefit of the doubt. When they die they deserve The dignity we would grant to any human being. In my personal opinion. I'm sure others might just disagree. As I've said before, I spent 3 years in a military police company, and although I wasn't an MP myself, I got to know cop "culture" about as well as anyone who's not a cop can.

All the guys I knew had either been cops before they joined the army or planned on becoming a police officer after they left. And although a few really were good and wanted to help people, the majority were sadists - one platoon used to really enjoy catching small animals like mice and frogs, put them in the microwave until they "popped", and then laugh about it hysterically.

People who think cases of police brutality can be explained away as someone just having a "bad day" have no idea what they're talking about

Lizard's Mouth Cleanup

I'd like to mention that people have been painting on rocks since people discovered how to make paint. The need to mark and claim is part of our very being.

As to the littering? Well, you can thank xtian philosophy which states the earth was put here for _our use_ and many don't seem to _also learn_ that includes _stewardship_. But, with so many xtians immersing themselves in apocalyptic philosophy (and the on-going middle east conflict doesn't help) they figure there isn't going to _be_ another generation or that those left behind aren't worth the effort and there you go.

I wish I was making it up, but the door to door preachers that've been hitting my door lately claim otherwise.

It's crazy.

Hmm. I am thinking something small but very nice that would be a lasting keepsake of your wedding day. It would
be good if all 4 could have the same thing but if not, at least similar value. How about classic earrings for the women that they could wear at the ceremony and long after--tiny diamond studs? For the men, if they have ear piercings I'd do the same. If not...would they wear watches? (I know some people just use cellphones for timepieces now.) Or if you have a nice photo of the six of you, give them that in a very nice frame. Given their ages, and the occasion, I'd do a nice wrapped small gift, not "goody bags" with a bunch of little stuff, but that's me, not you. If you really want to do bags...I dunno...gift card for Starbucks and a mug, gift card for See's and a nice candy dish?

Where Are The Hawks?

2014-09-17 09:11 AM

There is no doubt there's less hawks and there's a simple reason - no water means no food for prey animals (ground squirrels etc.). No prey animals means, no hawks. When we get rain, the prey animals left will breed and as their numbers increase, so the hawks will return...

Whoops, I meant to say that a few years ago a study (actually numerous studies) found that Medicaid (not Medicare) enrollees had no improved health outcome as opposed to folks with no health insurance.

And BTW, 399, although I admit I used to watch Fox news because Bill O'Reilly was someone I loved to hate, I stopped watching that channel because I just couldn't stand it anymore - I definitely did NOT get my health care info from Fox or some right wing site like Newsmax.

The sad truth is that a lot more people are going to be harmed than will actually get any improved benefit from ACA.

Thanks for the offer of pressure washer help, 409. Please email me at the address at the bottom of the page with my photos.

The rattler was so calm that at first I thought it was some unusual discarded item. I was about to pick it up and realized my mistake in time!

Thanks for the kind words. Yes, it is also a mystery to me how people can mess things up without it bothering them. Not sure whether it is worse to think they do it without thinking or fully aware.

Obviously, problems like climate change and international conflicts raise the same questions on a bigger scale.

Sometimes it feels like "cleanups" just enable bad behavior. But what is the alternative?

Best wishes,
Robert

409: That's a generous offer, but it probably would violate some laws or regulations, and it's doubtful the hose could reach. Some of these look to be half a mile or so from the trail head, which is as far as a truck can go. These aren't nice wide driveable paths (even if that were legal), but snake around and between rocks, go severely up and down, etc.

The Exxon Valdez - 25 Years Later

2014-09-17 08:47 AM

Little known to most people in Santa Barbara is the courageous stand that the County supervisors here took about a year before the Valdez disaster to not allow Exxon single hulled tankering in the SB channel. The manager of Exxon's tankering project was quite unusually verbally nasty to the Board at the denial, and he ironically was in charge when the Valdez hit the rocks. We dodged a huge bullet on that one, as that same drunk boat captain could have rammed that tanker on one of the Channel Islands or Point Conception instead of Alaska's Prince William Sound.

Bear Killed in Traffic Accident

2014-09-17 08:41 AM

Bears are considered sacred by almost all human being societies. All throughout the world. Obviously years and years ago at the dawn of history. My point is for me bears still carry that greatness of being sacred. In a way of being the magnificent animals. they are intelligent and have many admirable qualities. Emotionally we all carried The Bears sacredness through our human connection. Some being more in touch with this than others.
Or we just feel really sad that a innocent bear just searching for water was killed. I will leave this to the Ed had community members to decide for themselves. For me I'm sticking with this sacred story, it's more intriguing. It explains why am so sad. (and no anonymous poster, this does not in any way mean I want to kill a bear) OMG I have got to get over this!

I think it would be a good use of water if it doesn't break the law spraying the rock

@332
Obamacare doesn't work the way you heard it works on Fox News. Yes, there is a $6k Out of Pocket Max/deductible. The part Fox News won't tell you is that middle-class or poor consumers don't have to pay it because Obamacare covers the $6k with a cost-sharing subsidy paid to medical providers.

The typical Obamacare consumer--and I am one--is FAR better off with Obamacare than they ever were under the old Republican health insurance system.

380P- Consider the fact that Blue Shield bears some of the responsibility for not having providers in the area. It should be clear that, while reimbursements (payments) to treating providers/establishments have been plummeting for years (while requirements for doing the business of health care continue to skyrocket- including mandated electronic health records and the associated costs of hard- and software & IT, increases in business costs such as minimum wage & provision of benefits to employees, etc) , somehow Blue CROSS was able to come to rate agreements that SB could swallow. Likewise, the programs for veterans (I have experience only with TriCare), pays so little that docs/clinics can't afford to lose $ seeing those patients. I'm neither part of nor defending Sansum or SBCH, but sharing another view of that situation.

Where Are The Hawks?

2014-09-17 06:46 AM

I have them in my back yard year round except for this time of year and it's because the business next to me bulldozes their field to reduce fire fuel and risk. I figure that reduces the rodent population so the hawks "vacation" somewhere with a better buffet. They come back after a couple of months, when the grass grows up again. Sometimes there are full size juveniles with them, still wanting to be fed. I may be anthropomorphizing, but mom looks a bit annoyed!

Bear Killed in Traffic Accident

2014-09-17 06:26 AM

I read this posting with horror and true sadness. Several years ago a girlfriend and I were driving to the airport in the predawn hours when we came upon a large dark figure on the side of the road at San Antonio Creek Road. I slowed to a cautious stop thinking cattle had gotten on the highway when a bear lumbered across my headlights, jumped the barrier and disappeared. We were giddy with excitement and everyone that knows me knows this story because there isn't a time I pass "Bear Corner" that I don't recount the sighting. And now, my bear is gone. Our bear that was proof Santa Barbara could sustain such beautiful wildlife, is gone.
